Overcoming shortcomings and improving the effectiveness of People's Councils at the commune level (Part 2)

Confused monitoring

Supervision is one of the most basic and important functions of the People's Council at the commune level. However, the supervisory activities of the People's Council at the commune level in the province still reveal many limitations. The supervisory activities of the People's Council, the Standing Committee of the People's Council, the committees and delegates of the People's Council at the commune level are still formalistic, not substantial, and the supervisory efficiency is not high. Supervisory activities are sometimes confused and not comprehensive, especially on issues that voters and people are concerned about.

Typically, in the first 6 months of 2024, the Legal Committee (People's Council of Muong Bang Commune, Tua Chua District) only regularly monitored the issuance of documents of the People's Council and People's Committee of the commune, and monitored complaints and denunciations. Thematic monitoring work has not been implemented yet.

According to Mr. Tong Van Cuong, Head of the Legal Committee (People's Council of Muong Bang commune), the quality of delegates is still limited, so the supervision activities are somewhat affected, the results are not high. In addition, the members mainly work part-time, many tasks dominate, so it is very difficult to arrange time to fully participate in the activities. Participation in giving opinions on the supervision and examination of the contents submitted to the People's Council meeting is still limited, there is no objection, mainly consensus.

According to the plan, every year the People's Council at the commune level develops a program and monitoring plan. However, many delegates do not know how to monitor and what issues to monitor. Many times, they have to ask for opinions from the Party Committee and the government before monitoring. In particular, monitoring issues related to revenue and expenditure of the budget, capital construction investment, land, etc. are difficult areas, requiring delegates to have professional qualifications and in-depth knowledge to understand. However, most delegates in villages and hamlets have very limited knowledge in these areas, and many delegates go to monitor only to have enough members according to regulations.

The selection of supervision contents by the People's Councils of some communes is not focused, key, and not suitable to the requirements, tasks of the locality and the interests of public opinion. Many communes choose easy supervision contents, such as the implementation of the review of poor and near-poor households, cultural supervision, propaganda work, dissemination of laws and grassroots mediation, etc.

In addition, the methods and forms of supervision still have many shortcomings. Supervision mainly consists of listening to reports on achieved results, lacking direct supervision, lacking contact with voters at their residence and workplace. Conclusions after supervision are often general; the work of monitoring, urging, and checking recommendations after supervision is not seriously implemented, and the supervised issues are not thoroughly investigated. Therefore, the supervision effectiveness of the People's Council at the commune level is generally not high, heavy on formalities, lacking substance. The results of supervisions have almost not discovered any problems or limitations of the supervised units; if any, they are only minor and insignificant limitations.

Mr. Thao A Vang, Vice Chairman of the People's Council of Sinh Phinh Commune, Tua Chua District, said: Every year, the People's Council of the commune develops a monitoring plan, focusing on issues of payment for forest environmental services; the movement of the whole people uniting to build a cultural life; policies to support students... However, due to many delegates' limited capacity and qualifications while the monitoring content requires specialized expertise, many delegates are confused, affecting the monitoring results.

Formal decision

In fact, the function of deciding on local issues of the People's Council at the commune level is mostly to "decide according to, re-decide" the contents and issues that have been considered, commented on and approved by the Party Committee Standing Committee. Or according to specific directives from higher levels (decisions or notices assigning specific plans and targets).

The 10th session of the People's Council of Muong Bang commune, term XXI, 2021 - 2026 took place in one morning.

Therefore, each year, the People's Council at the commune level holds two sessions, passes and issues a number of resolutions (the form is the same, the content only changes slightly in the assessment of the situation and the figures). Some People's Councils at the commune level have not yet ensured compliance with regulations on the content, form, time and manner of conducting the session. The People's Council session in some communes is arranged in one session to pass pre-decided contents, in order to legitimize the economic and social targets set by the Party Committee.

Therefore, many People's Council resolutions, after being issued, are not implemented, or if implemented, are ineffective and must be abolished.

Mr. Lo Van Kien, Party Secretary, Chairman of Thanh Yen Commune People's Council, Dien Bien District shared: Every year, at the Commune People's Council meetings, resolutions on socio-economic development and ensuring local defense and security are passed. However, before the People's Council passed them, the Standing Committee of the Commune Party Committee reviewed, analyzed, and gave policies. At the meeting, most delegates voted to pass the resolutions. Lacking criticism and multi-dimensional analysis, there were also resolutions that, due to objective and subjective reasons, were not effective after being passed.

Since the beginning of the 2021 - 2026 term, the People's Councils at the commune level in Dien Bien province have issued thousands of resolutions. The number is large, but mainly regular resolutions on socio-economics, settlement, budget estimates, revenue and expenditure, etc. Meanwhile, the research and promulgation of specific legal resolutions, regulations on mechanisms and policies to promote the potential and strengths of the locality are very few, or even non-existent. For example, at the 10th session of the People's Council of Muong Bang commune (Tua Chua district), term XXI, term 2021 - 2026 (held on the morning of June 26, 2024), mainly focused on implementing the ritual and procedural part, delegates agreed with the submissions and draft resolutions presented by the People's Committee, without any objections or clarification of difficulties and obstacles.

Mr. Pham Thanh Phuong, Vice Chairman of the People's Council of Tua Chua district, shared: At many meetings of the People's Council at the district level and above, many resolutions submitted by the People's Committee at the same level were not passed because the People's Council delegates found that they did not meet the requirements as prescribed, the feasibility and effectiveness of the resolutions. However, for the People's Council at the commune level, all resolutions were passed. Partly because the resolutions related to socio-economic development are often based on assigned targets. At the same time, many delegates did not discuss or give opinions but mainly agreed; while the delegates who are farmers have limited professional qualifications, so they did not participate in giving opinions. Therefore, the content of some resolutions is still general, lacking in rigor and legal basis; the statistics are inaccurate; the assessments are not convincing.

The resolution issuance activities of the People's Council at the commune level are very important and necessary. To meet the requirements and tasks, based on the specific conditions of each locality, the People's Council at the commune level must improve the quality of resolution issuance activities, ensuring that the resolutions are feasible, put into practice, and contribute significantly and directly to the successful implementation of local socio-economic development goals.
