Plan to handle some issues related to the reorganization of the State apparatus in Lam Dong province

Chairman of Lam Dong Provincial People's Committee Tran Hong Thai signed and issued Plan No. 1984/KH-UBND dated February 28, 2025 on the implementation of Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus in Lam Dong province.

The plan aims to promptly and seriously disseminate and implement Resolution No. 190/2025/QH15 in a synchronous, unified and effective manner; determine the content of the work, completion deadline, and responsibilities of relevant agencies and organizations in organizing the implementation of Resolution No. 190/2025/QH15; raise awareness and responsibility of all levels, sectors and localities in the province in implementing Resolution No. 190/2025/QH15.

The plan requires ensuring unified direction of the Provincial People's Committee and the Chairman of the Provincial People's Committee; proactive, close, regular and effective coordination between specialized agencies under the Provincial People's Committee, other agencies and units under the Provincial People's Committee, People's Committees of districts, Da Lat city, Bao Loc and relevant agencies and organizations in implementing Resolution No. 190/2025/QH15.

The plan clearly and specifically defines the content of the work, completion time, and responsibilities of agencies, organizations, and localities for unified implementation in the province.

Accordingly, before March 10, departments, branches, agencies, units of the province; People's Committees of districts, cities and related agencies and organizations (hereinafter referred to as agencies, units, localities) shall organize the development and promulgation of plans to implement Resolution No. 190/2025/QH15 at agencies, units, localities and send the plan to the Department of Home Affairs for monitoring and urging implementation; organize timely, complete and serious dissemination of the contents of Resolution No. 190/2025/QH15 so that the implementation of the Resolution is unified and effective in the province.

In the process of implementing Resolution No. 190/2025/QH15, the Provincial Radio and Television Station, Lam Dong Newspaper, news agencies, newspapers, associations and relevant agencies and organizations located in the province shall propagate and communicate in appropriate and effective forms so that individuals, businesses, agencies and organizations know and implement contents related to individuals, businesses, agencies and organizations when the agencies carry out the arrangement of the apparatus.

Agencies, units, localities; agencies receiving functions, tasks, and powers after implementing the organizational arrangement and related agencies and organizations shall immediately implement and be responsible for publicly announcing the contents of the Decision in Article 12 of Resolution No. 190/2025/QH15 to ensure timeliness and create conditions for agencies, organizations, individuals, and enterprises to easily access.

During the implementation of Resolution No. 190/2025/QH15, relevant agencies, units, localities and individuals shall receive, respond, guide and answer questions related to the functions, tasks and powers of their agencies when receiving requests and recommendations from agencies, organizations and individuals to ensure implementation of the principles prescribed in Article 2 of Resolution No. 190/2025/QH15.

At the same time, organize a review and accurately identify legal documents affected by the organizational arrangement, develop plans and roadmaps for handling legal documents. Completion time: Before May 19, 2025 (03 months from the effective date of Resolution No. 190/2025/QH15).

Implement amendments, supplements, replacements, repeals, and promulgates legal documents or propose competent agencies and individuals to amend, supplement, replace, repeals, and promulgates legal documents affected by the organizational structure. Report the results to the Department of Justice for synthesis before June 1, 2025. The Department of Justice shall preside over and coordinate with the Department of Home Affairs and relevant agencies and organizations to monitor, urge, guide, synthesize, and report to the Provincial People's Committee and the Ministry of Justice as prescribed before June 30, 2025. Completion time: Before March 1, 2027 (According to the plan and roadmap for document processing based on the results of document review).

Agencies, units and localities are responsible for monitoring, organizing implementation and coordinating with relevant agencies to implement Resolution No. 190/2025/QH15 within the scope of their functions, tasks and powers as prescribed. The Department of Home Affairs shall proactively monitor and urge in general, and if necessary, report to the Provincial People's Committee for consideration and direction.

Every quarter, agencies, units and localities are responsible for advising the Provincial People's Committee to review and resolve arising issues within their state management scope; prepare reports after implementation, send them to the Department of Home Affairs for general synthesis, and report to the Provincial People's Committee to report to the Ministry of Home Affairs according to regulations.

The plan also clearly states the responsibility for implementation for each department and branch such as: Department of Home Affairs, Department of Justice, Provincial Police, Provincial Inspectorate, Department of Finance; Directors, Heads of departments, branches, and branches; Chairmen of People's Committees of districts, cities, and related agencies, organizations, and individuals.

Funding to ensure the implementation of the plan is allocated from the state budget and other sources according to the provisions of law. Agencies assigned to preside over the implementation of tasks according to the plan are responsible for preparing budget estimates to ensure the implementation of Resolution No. 190/2025/QH15, and submitting them to competent agencies for approval of annual budget estimates according to the provisions of law.

In the process of implementing the plan, if there are any difficulties or problems, agencies, organizations, units and localities are requested to promptly report to the Department of Home Affairs and the Department of Justice for synthesis, guidance on resolution or submission to competent authorities for consideration and decision.

Previously, on February 19, the National Assembly issued Resolution No. 190/2025/QH15 regulating the handling of a number of issues related to the reorganization of the state apparatus.

The Resolution consists of 15 articles, stipulating: Scope of regulation (Article 1); Principles for handling a number of issues related to the arrangement of the state apparatus (Article 2); Names and use of seals of competent agencies and positions (Article 3); Implementation of functions, tasks and powers of competent agencies and positions (Article 4); Implementation of administrative procedures (Article 5); Detention, temporary detention, prosecution and execution of judgments (Article 6); Implementation of functions and tasks of inspection, reception of citizens, settlement of complaints and denunciations, prevention and combat of corruption and negativity (Article 7); Authority to sanction administrative violations (Article 8); Implementation of international treaties and international agreements (Article 9); Documents and papers issued and granted by competent agencies and positions (Article 10); Review and processing of documents (Article 11); Responsibility for publicizing information and providing implementation instructions (Article 12); Resolving issues arising in the reorganization of the state apparatus (Article 13); Implementation (Article 14); Effectiveness (Article 15).
