To implement the 2024 Land Law, the Government has assigned the Ministry of Natural Resources and Environment to preside over and coordinate with central and local ministries, branches and localities to study and amend the provisions of Decree No. 91/2019/ND-CP dated November 19, 2019 of the Government on administrative sanctions for violations in the land sector for submission to the Government for consideration and promulgation. Accordingly, the draft includes 4 chapters and 36 articles; of which 4 chapters remain unchanged and 8 articles are reduced compared to Decree No. 91/2019/ND-CP, specifically regulating the forms, levels of sanctions and remedial measures; authority to sanction administrative violations, implementation provisions, etc.

After listening to the comments of experts, leaders of ministries, branches and localities; Deputy Prime Minister Tran Hong Ha said that the development of a new Decree is very necessary, meeting practical requirements in the current period and effectively overcoming previous shortcomings and inadequacies. Therefore, it is recommended that the drafting agency analyze and clarify the contents on the level of violations and sanctions; decentralize and specifically delegate power to each agency and unit in implementing the task of sanctioning in the field of land, especially at the district and commune levels. For some inappropriate contents, it is necessary to remove and update new regulations according to the principle of compliance with relevant legal provisions, in order to ensure stability and feasibility when applied in practice.
