At the conference, representatives of the Ministry of Agriculture and Environment presented the basic contents of the draft Decree amending a number of Decrees in the field of fisheries. Specifically, the draft Decree consists of 6 articles: Article 1. Amending and supplementing a number of articles of Decree No. 26/2019/ND-CP dated March 8, 2019 of the Government detailing a number of articles and measures to implement the Law on Fisheries, which has been amended and supplemented by a number of articles under Decree No. 37/2024/ND-CP dated April 4, 2024 of the Government; Article 2. Amending and supplementing a number of articles of Decree No. 38/2024/ND-CP dated April 5, 2024 of the Government regulating administrative sanctions for violations in the field of fisheries; Article 3. Abolish a number of words, phrases, points, clauses, and articles of Decree No. 26/2019/ND-CP that have been supplemented under Decree No. 37/2024/ND-CP; Article 4. Abolish Clause 4, Article 42 of Decree No. 38/2024/ND-CP dated April 5, 2024 of the Government regulating administrative sanctions for violations in the field of fisheries; Article 5. Speaking at the conference, Standing Vice Chairman of the Provincial People's Committee Nguyen Tuan Thanh said that in recent times, Binh Dinh province has resolutely implemented tasks and solutions to combat illegal, unreported and unregulated fishing (combat IUU fishing). In particular, the province has completed procedures for registering, inspecting and licensing fishing vessels according to regulations; for fishing vessels that do not meet the requirements for inspection and those that have not completed registration, inspection and licensing according to regulations, localities in the province will make a management list, bring them to a centralized area, seal the fishing vessels, and resolutely not allow them to leave port. For groups of fishing vessels at high risk of violating foreign waters, localities will continue to coordinate with agencies and functional units in the southern provinces to propagate and mobilize ship owners (or captains) to strictly comply with the provisions of the law, commit not to violate foreign waters when going to sea; must connect to VMS when leaving port. Assign the Provincial Border Guard Command to organize punishment for fishing vessels that violate the regulations on losing connection to monitoring the journey as soon as the vessel returns to shore, prohibiting them from continuing to go to sea to fish; work with telecommunications companies to clearly identify the cause, not to take advantage of technical errors in the transmission line connection to disconnect the journey monitoring device to bypass the authorities, violating fishing in foreign waters. Comrade Nguyen Tuan Thanh highly agreed with the content of the draft Decree amending a number of Decrees in the field of fisheries drafted by the Ministry of Agriculture and Environment, especially the content of abolishing the regulation on the minimum size allowed to exploit a number of aquatic species living in natural waters in Decree 37/2024/ND-CP. In addition, Permanent Vice Chairman Nguyen Tuan Thanh proposed to review, edit and supplement a number of contents related to the issuance of documents approving the purchase of fishing vessels outside the province and transferring quotas of offshore fishing licenses; regulations on the issuance, re-issuance and revocation of Certificates of establishments qualified to build and convert fishing vessels.
Concluding the conference, Deputy Prime Minister Tran Hong Ha emphasized that it is necessary to develop a Decree amending Decree No. 37/2024/ND-CP dated April 4, 2024 and Decree No. 38/2024/ND-CP dated April 5, 2024 of the Government to promptly remove difficulties and obstacles encountered in practice that have been proposed by fishermen, unions and associations in the past regarding the minimum size allowed to be exploited for aquatic species and "mixing of raw materials" affecting the production, processing and export of aquatic products. Protecting aquatic resources through measures to limit the minimum size allowed to be exploited is necessary, but there needs to be a reasonable roadmap combined with propaganda, dissemination and step-by-step alternative measures for effective exploitation, especially for species of economic value that are being used as raw materials for export.
Deputy Prime Minister Tran Hong Ha noted that the drafting of the revised and supplemented Decree needs to address the causes and specific legal regulations in fisheries exploitation; consider handling violations when ship owners remove monitoring equipment on ships during fishing activities at sea; apply technology in observing and locating fishing vessels; manage workers participating in fishing at sea; determine fishing areas and manage according to fishing grounds...
