Complete the Planning dossiers of 12 provinces and cities, submit to the Prime Minister before October 26

Accordingly, on October 23, 2023, the Government Office issued Document No. 430/TB-VPCP announcing the conclusion of Deputy Prime Minister Tran Hong Ha at an online meeting with 12 localities on accelerating the progress of completing the dossier for approval of the Provincial Planning for the period 2021 - 2030, with a vision to 2050.

According to the above conclusion announcement, Deputy Prime Minister Tran Hong Ha requested the Chairmen of the People's Committees of the provinces and centrally-run cities: Hai Phong, Da Nang, Ha Giang, Bac Kan, Phu Tho, Bac Ninh, Quang Ngai, Binh Phuoc, Ba Ria - Vung Tau, An Giang, Kien Giang, Ca Mau to urgently direct the completion of the Provincial and Municipal Planning dossiers; submit to the Prime Minister before October 26, 2023.

The conclusion announcement clearly stated that, through reviewing the documents and opinions of 12 localities (Hai Phong, Da Nang, Ha Giang, Bac Kan, Phu Tho, Bac Ninh, Quang Ngai, Binh Phuoc, Ba Ria - Vung Tau, An Giang, Kien Giang, Ca Mau) and the ministries and agencies at the meeting, 07 groups of issues were identified that most localities were still having problems with. The meeting agreed on the handling principles for localities to study, absorb, and complete the documents for submission for approval of the Provincial Planning, specifically as follows:

Firstly, regarding Power Plan VIII (on the plan for developing the power supply network): The Chairman of the People's Committee of the province or centrally-run city is responsible for directing the updating of important projects and works with investment priorities identified in Power Plan VIII into the Provincial Plan.

The People's Committees of provinces and centrally run cities shall, based on the socio-economic development needs and the potential for electricity development of the locality, propose to supplement the list of potential power source projects and potential power grids in the Provincial Plan, but must be consistent with the viewpoints, objectives, orientations, plans for power source and grid development, criteria and justifications in the VIII Power Plan. The implementation of the above projects shall only be carried out when they are consistent with the VIII Power Plan implementation plan approved by competent authorities, consistent with the conditions, criteria and justifications in the VIII Power Plan and have the investment policy approved by competent authorities in accordance with relevant legal provisions.

Second, regarding mineral planning (on plans for protection, exploitation and use of mineral resources): People's Committees of provinces and centrally run cities review and propose plans for protection, exploitation and use of mineral resources to ensure compliance with the Planning for exploration, exploitation, processing and use of minerals for the period 2021 - 2030, with a vision to 2050 approved by the Prime Minister in Decision No. 866/QD-TTg dated July 18, 2023, the Planning for basic geological survey of minerals for the period 2021 - 2030, with a vision to 2050 approved by the Prime Minister in Decision No. 680/QD-TTg dated June 10, 2023, national sectoral planning and other relevant regulations.

In case of any problems arising in the implementation of the Provincial Planning related to the delimitation of national mineral reserve areas, the Ministry of Natural Resources and Environment shall preside over and coordinate with the Ministries of Industry and Trade, Construction and relevant agencies to guide localities; report to competent authorities on matters beyond their authority.

Third, regarding the development plan of sectors, fields, functional areas and other contents in the Provincial Planning (transportation, urban, industrial, tourism, forestry, sea encroachment, etc.): Based on the socio-economic development orientation of the locality, the People's Committees of provinces and centrally-run cities can propose land use needs according to the development plan of sectors, fields, functional areas and other contents in the Provincial Planning to ensure consistency with the planning period up to 2030, with a vision to 2050 (with long-term orientation).

The implementation of projects after the Provincial Planning is approved must ensure compliance with the land use planning targets for 2021 - 2030 and the 5-year national land use plan for 2021 - 2025 allocated to provinces and centrally run cities according to Decision No. 326/QD-TTg dated March 9, 2022 of the Prime Minister and adjustment and supplement decisions (if any) of competent authorities.

Fourthly , regarding the Forestry Planning (on the forest cover ratio and forest area in the Provincial Planning): Currently, the National Forestry Planning has not been approved by the Prime Minister. In the process of formulating the Provincial Planning, the People's Committees of provinces and centrally run cities shall review and determine the forest cover ratio and forest area in the Provincial Planning to ensure compliance with the Party's policies and directions on forest protection and development and forest land use targets approved in Decision No. 326/QD-TTg dated March 9, 2022 of the Prime Minister.

Fifth, regarding the list of projects expected to be prioritized for implementation: The People's Committees of provinces and centrally-run cities shall review and may propose projects and works that are being reviewed and handled according to the Conclusions of inspection, examination, investigation, audit and execution of judgments into the list of projects expected to be prioritized for implementation in accordance with the orientation of the Provincial Planning, but in the document submitted to the Prime Minister, they must commit not to legalize violations and take full responsibility before the law and the Prime Minister for the process of establishing, appraising, approving policies and deciding on project investment according to the principle that they can only be implemented after fully implementing the contents according to the Conclusions of inspection, examination, investigation, audit, judgments and being approved by competent authorities, ensuring compliance with current regulations.

Sixth , regarding the plan to arrange administrative units (ADUs) at district and commune levels: Implement according to Official Dispatch No. 616/CD-TTg dated July 4, 2023 of the Prime Minister; accordingly, it is necessary to show the directional content in the arrangement of ADUs at district and commune levels in the Provincial Planning.

The determination of scope, boundaries, geographical names and implementation of specific arrangement plans for administrative units at district and commune levels will be carried out according to the decision of competent authorities.

Seventh, regarding the plan to determine the defense area: The Chairman of the People's Committee of the province or centrally-run city directs the review and updating of contents related to the defense sector in the Provincial Planning, ensuring compliance with Decision No. 2256/QD-BQP dated May 30, 2023 of the Minister of National Defense.

The Deputy Prime Minister requested the Chairmen of the People's Committees of provinces and centrally run cities to urgently direct the completion of the preparation, submission for appraisal and approval of the Provincial Planning in accordance with the above contents; be responsible for reviewing the contents of the Provincial Planning to ensure consistency and synchronization with national sectoral planning and regional planning that have been decided or approved by competent authorities; if there are any other problems or difficulties other than the 7 groups of issues mentioned above, promptly report to the Prime Minister to direct relevant ministries and agencies to guide and handle them according to their authority or organize meetings to agree on solutions to remove them, speed up the approval progress of the Provincial Planning; strive to complete the approval of the Provincial Planning in 2023 in accordance with the direction in Resolution 90/NQ-CP dated June 16, 2023 of the Government and Directive No. 15/CT-TTg dated May 25, 2023 of the Prime Minister.

Ministries and agencies, according to their assigned functions and tasks, are responsible for providing clear and timely comments during the process of collecting comments, appraising and reviewing the Provincial Planning dossier; in case of no written comments within the deadline, they are considered to agree and are responsible to the Prime Minister.
