Báo Dân tríBáo Dân trí08/03/2025

(Dan Tri) - Mr. Nam has paid social insurance for 18 years but had to stop due to illness. He does not know if he is eligible for a pension or not?

Mr. Nam was born in August 1971, has paid compulsory social insurance for 13 years, then he paid voluntary social insurance for another 5 years (from 2020-2025). The total time Mr. Nam paid social insurance is 18 years.

In recent years, Mr. Nam has been sick and unable to work, so he has participated in voluntary social insurance. However, he is no longer able to continue paying voluntary social insurance. He has stopped paying and hopes to have a financial source to solve his current difficulties.

He asked: "Will I receive my pension by the end of 2025? If I haven't received my pension yet, can I withdraw my social insurance at once?"

From July 1, workers who are of retirement age and have paid social insurance for 15 years are eligible to receive a pension (Illustration: Son Nguyen).

According to Vietnam Social Security, from July 1, 2025, the social insurance regime will be applied according to the Social Insurance Law 2024. Article 98 of the Social Insurance Law 2024 stipulates: "Voluntary social insurance participants are entitled to pension when they reach retirement age as prescribed in Clause 2, Article 169 of the Labor Code and have paid social insurance for 15 years or more".

Thus, the minimum requirement for social insurance contributions to receive pension is 15 years. Mr. Nam has paid social insurance for 18 years, which means he meets this requirement.

However, in Mr. Nam's case, the second condition for receiving a pension must be considered, which is whether or not he is of the prescribed retirement age.

Clause 2, Article 169 of the 2019 Labor Code stipulates that the retirement age of employees in normal working conditions will be adjusted according to a roadmap until reaching 62 years old for male employees in 2028 and 60 years old for female employees in 2035.

From 2021, the retirement age of employees under normal conditions is 60 years and 3 months for male employees and 55 years and 4 months for female employees; then, each year it increases by 3 months for male employees and 4 months for female employees.

According to Vietnam Social Security, Mr. Nam was born in August 1971 and will be 54 years and 5 months old by the end of 2025, not yet eligible for retirement benefits.

Vietnam Social Security advises Mr. Nam to reserve his social insurance contribution period and wait until he is 62 years old to enjoy retirement benefits according to regulations.

In case you wish to receive a one-time social insurance payment, Vietnam Social Security will guide you to go to the local social security office where you reside to get it resolved according to regulations.
