Recently, the People's Committee of Hai Duong province issued Decision 37/2024 regulating the land allocation limit, the residential land recognition limit, the agricultural land use right transfer limit; conditions for land division and land consolidation; the minimum area allowed for land division and land consolidation in the area. This regulation takes effect from September 12.

According to regulations, the land allocation limit for individuals in urban areas adjacent to national highways, provincial roads, district roads, streets, roads in urban areas, and residential areas is at least 40 square meters and at most 80 square meters; for other land locations, the minimum allocation limit is 40 square meters and at most 120 square meters.

In rural areas, locations adjacent to national highways, provincial roads, district roads, streets, roads in urban areas, residential areas, the minimum allocation area is 40m2, maximum 120m2; for remaining land locations, the minimum allocation area is 60m2, maximum 200m2.

In rural mountainous areas, locations adjacent to national highways, provincial roads, district roads and in newly planned residential areas and points, the minimum allocation is 100m2, the maximum is 180m2; for the remaining land locations, the minimum allocation is 150m2, the maximum is 300m2.

For the limit of unused land allocation to individuals for use according to the planning and land use plan approved by competent authorities for the purpose of annual crop planting and aquaculture, no more than 1 ha for each type of land; the purpose of perennial crop planting, production forest land is planted forest, protective forest land is no more than 5 ha for each type of land.

The new land allocation limit for religious organizations and affiliated religious organizations to build religious facilities that are not historical-cultural relics or scenic spots shall not exceed 0.5 hectares.

The annual land allocation limit for planting trees and aquaculture for families and individuals using land that is self-reclaimed and has no disputes is no more than 1 hectare for each type of land.

The limit for allocation of land for perennial crops, protective forest land, and production forest land that are planted forests for families and individuals currently using due to self-reclamation and without disputes is no more than 5 hectares for each type of land.

For households and individuals using residential land that was formed and used before December 18, 1980, located adjacent to national highways, provincial roads, district roads, streets, roads in urban areas, and residential areas in urban areas, the recognized residential land limit is 400m2, and for the remaining land locations, the recognized residential land limit is 600m2.

In rural areas, locations adjacent to national highways, provincial roads, district roads, inter-village and inter-commune roads, the recognized residential land limit is 600m2, the remaining land locations are 1,000m2.

In mountainous rural areas, the location adjacent to national highways, provincial roads, district roads, inter-village and inter-commune roads, the recognized residential land limit is 900m2, the remaining land locations are 1,500m2.

In case a family or individual is using a land plot that was formed and used from December 18, 1980 to before October 15, 1993, the limit for recognizing residential land in urban areas adjacent to national highways, provincial roads, district roads, streets, roads in urban areas, and residential areas is 350 square meters, and the remaining land area is 550 square meters.

Rural areas, locations adjacent to national highways, provincial roads, district roads, inter-village and inter-commune roads, the recognized residential land limit is 500m2, the remaining land locations are 900m2.

In mountainous rural areas, at the location adjacent to national highways, provincial roads, district roads, inter-village and inter-commune roads, the recognized residential land limit is 800m2, the remaining land location is 1,400m2.

The limit for receiving the right to transfer land use rights for annual crop cultivation and aquaculture is not more than 20 hectares for each type of land; land for perennial crop cultivation is not more than 100 hectares; land for protective forests and production forests are planted forests not more than 150 hectares.

In addition, the decision also specifies the minimum area allowed for land subdivision.

Specifically, residential land in urban areas has a minimum area of ​​30 square meters and a minimum side adjacent to the road or common walkway of 3 meters; the depth into the land perpendicular to the road or common walkway is at least 5 meters.

Residential land in rural areas has a minimum area of ​​60m2 and a minimum side adjacent to the main road of 4m, and a minimum depth into the plot perpendicular to the main road of 5m.
