The Ministry of Industry and Trade is seeking comments on a draft Circular regulating the allocation of import tariff quotas for used cars committed to in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).

The types, HS codes and import tariff quotas for used cars each year are specified in Appendix I as follows: Motor vehicles for the transport of 10 or more persons (Code 87.02); motor cars and other motor vehicles designed primarily for the transport of persons, including passenger cars with common luggage compartments and racing cars (Code 87.03); motor vehicles for the transport of goods (87.04).

The draft clearly states that the regulations for used cars imported under the tariff quota committed in the CPTPP Agreement are as follows:

Used cars are cars that have been registered for circulation in the exporting country before arriving at the Vietnamese border gate according to the provisions of law; Used cars imported under the tariff quota specified in Article 3 of this Circular must meet the rules of origin of goods in the CPTPP Agreement and must have a Certificate of Origin when carrying out import procedures.

Used cars imported under tariff quotas must comply with current legal regulations on technical standards, technical safety quality and environmental protection for cars, and regulations on car import border gates; The type of imported car must comply with the content of the Car Import Business License as prescribed by law.

Regarding the rights and obligations of traders assigned import tariff quotas for used cars committed to in the CPTPP Agreement, the draft states that traders assigned tariff quotas have the right to receive a written notice of the assignment of import rights according to the tariff quota (after paying the auction winning amount).

Traders who are assigned import tariff quotas for used cars can pay the auction winning amount when assigned tariff quotas into the account of the Ministry of Industry and Trade within 5 working days from the announcement of the results on the Ministry of Industry and Trade's electronic information portal (www.moit.gov.vn) and send documents confirming the amount paid to the focal agency, the Import-Export Department, Ministry of Industry and Trade, address 54 Hai Ba Trung, Hoan Kiem, Hanoi.

If the trader does not pay the money (the time of payment is the time when the Ministry of Industry and Trade's account reports a receipt) or the trader refuses the assigned tariff quota, the notification of the result of the assigned tariff quota will automatically expire and the focal agency will report to the Minister of Industry and Trade for decision.

According to the draft, the Auction Council shall promulgate auction regulations and implement procedures for allocating import tariff quotas for used cars through auctions based on the provisions of the Law on Property Auctions and Decree No. 62/2017/ND-CP dated May 16, 2017 of the Government detailing a number of articles on measures to implement the Law on Property Auctions.

The organization of import tariff quota allocation is periodically carried out in the first quarter of each year and the allocation period can be extended depending on specific cases and must be approved by the Minister of Industry and Trade.

Information on the time of organizing the allocation of import tariff quotas and receiving registration dossiers to participate in the allocation session shall be announced through mass media at least 14 days before the allocation.

The names of traders assigned quotas and the amount of tariff quotas shall be announced through the mass media within 14 days after the date of allocation.
