Presenting the draft Law, Minister of Culture, Sports and Tourism Nguyen Van Hung said that the draft Law consists of 3 Articles, specifying the content of 3 policies in the proposed Law that have been approved, including: policy 1 "Perfecting regulations on advertising content and forms suitable for the diverse development of advertising activities"; policy 2 "Perfecting regulations on the management of advertising activities in the press, online environment and cross-border advertising services"; policy 3 "Perfecting regulations on outdoor advertising activities".
The amended and supplemented Law on requirements for advertising content: advertising content must ensure honesty, accuracy, clarity, and not cause misunderstanding about the features, quality, uses, and effects of products, goods, and services; in case the advertisement includes notes or recommendations, the notes and recommendations must ensure a clear, complete, and accessible form of expression.
Supplementing regulations on the rights and obligations of the person delivering advertising products and requiring the responsibility of the person delivering advertising products who is an influential person according to the provisions of the law on consumer protection. The person delivering advertising products has the following responsibilities: Providing documents related to advertising content, revenue, product name, quantity of each product arising from periodic advertising activities at the request of the tax authority or when requested by a competent state agency...
The person who delivers the advertising product is an influencer responsible for: Notifying consumers in advance that he/she is advertising; when posting opinions and feelings about the results of using cosmetics, health protection foods, and dietary supplements on social networks, he/she must be a person who has directly used the product.
The draft Law amending regulations on advertising activities in printed newspapers: The advertising area in printed newspapers must not exceed 30% of the total area of a newspaper publication or 40% of the total area of a magazine publication, except for newspapers and magazines specializing in advertising, and must have signs to distinguish advertising from other content.
Amending regulations on advertising activities in newspapers and television to increase advertising time on pay TV channels; in feature film programs.

Agree with the view of increasing advertising space in newspapers and magazines
Presenting the review report, Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh requested the drafting agency to research and design regulations on the rights and obligations of those who transmit advertising products in a direction that specifically defines the position, role and responsibility of organizations and individuals in online advertising activities. On that basis, there will be appropriate regulations for those who transmit advertising products, especially those who have influence on the internet.
The Standing Committee of the National Assembly's Committee on Culture and Education agrees with the view of increasing advertising space on newspapers and magazines to help press agencies increase revenue and better implement the financial autonomy mechanism when the current Law stipulates that advertising space must not exceed 15% of the total area of a newspaper publication or 20% of the total area of a magazine publication. At the same time, to protect the interests of readers, it is recommended that the drafting agency study and adjust in the direction of specific regulations on the ratio of advertising space and position for each different type of newspaper and magazine publication.
Discussing at the meeting, members of the National Assembly Standing Committee emphasized that false advertising in the mass media is quite common. Some cases lead to consumers believing, buying and using products, wasting money without bringing benefits. Therefore, it is necessary to have regulations to handle, control, count, monitor, and at the same time clarify the responsibility of state management agencies for this issue.
Opinions are also concerned with the requirements for locations planned for outdoor advertising and note the need to review to ensure stricter implementation for business management agencies and people. For example, advertising planning locations must not be located in the safety corridor of dikes or the national power grid; ensure traffic safety on air and rail routes; ensure that they do not affect architecture and urban landscapes, etc. At the same time, determine locations for non-profit propaganda and advertising activities.
Regarding online advertising, members of the National Assembly Standing Committee agreed to amend the waiting time for online advertising to be turned on or off to suit the reality and development trends of advertising in the world. However, the adjustment of 4 times, from 1.5 seconds to 6 seconds, needs to be assessed for impact and explained carefully to ensure objectivity and persuasion.
At the meeting, discussing further on this issue, Deputy Minister of Information and Communications Nguyen Thanh Lam said that the form of advertising that automatically pops up when users open a browser or access a website is not the only form of advertising on the Internet. At the same time, the amendment and supplementation of a number of articles of the Advertising Law has the main goal of bringing state management of advertising to the same level between domestic enterprises and cross-border enterprises. Therefore, the regulation will be applied to all enterprises.
Concluding the meeting, Vice Chairwoman of the National Assembly Nguyen Thi Thanh said that regarding the scope of amendments and supplements, the National Assembly Standing Committee proposed to continue reviewing the fields, means, methods, and approaches to more comprehensively identify advertising activities and anticipate developments in practice and the future.
Regarding the responsibility of state management of advertising activities, the Vice Chairman of the National Assembly proposed to continue reviewing and supplementing the responsibilities of relevant ministries such as the Ministry of Industry and Trade, the Ministry of Public Security and other ministries to ensure requirements on ideological security, cultural security, economic security, security and order, etc.
