Amending the Advertising Law: More clearly stipulate the prohibition of advertising that negatively affects children

Protecting children's rights in advertising

Concerned about the impact of advertising on children, National Assembly delegate Trinh Thi Tu Anh (Lam Dong delegation) stated that in reality, children are increasingly facing sophisticated forms of advertising, requiring specific legal regulations to protect their rights.

Accordingly, in the digital age, children are facing a huge "ocean" of advertising. Smart algorithms constantly analyze children's behavior to provide personalized ads, invisibly creating great pressure on their psychology.

Too early and too often exposure to advertising can lead to problems such as impulsive consumption, the formation of unhealthy standards of beauty and success, and even cause psychological disorders.

To protect the future of the younger generation, delegate Trinh Thi Tu Anh emphasized that more drastic actions are needed. Despite clear regulations, protecting children from advertising, especially on social networks, remains a challenge.

Notably, social media advertising is diverse and difficult to control, especially ads displayed on unofficial websites. Advertisers are always looking for new ways to attract children's attention, sometimes exceeding the legal limits. Many parents are not fully aware of the harmful effects of advertising on children, leading to a lack of close supervision.

Delegate Trinh Thi Tu Anh suggested that the draft Law should add a clear definition of "advertising aimed at children", including both direct and indirect advertising. At the same time, it is necessary to detail regulations on the content and form of advertising aimed at children, strengthen sanctions against organizations and individuals who violate regulations; and build an effective monitoring mechanism to detect and handle violations.

In addition, there is a need to strengthen cooperation with other countries to share information and experiences and jointly develop common standards for advertising targeting children on cross-border platforms.

Sharing the same view, delegate Le Van Kham (Binh Duong delegation) said that many studies have shown that advertising has an impact and cumulative impact on emotions, behaviors, perceptions of standards, and impacts on children's psychology, attitudes, and lifestyles. Therefore, the current Advertising Law has provisions prohibiting advertising that makes children think and act against ethics and good customs and practices, and prohibiting advertising that negatively affects children's health and normal development.

“These regulations are correct but still relatively general and not really clear. Identifying or assessing the negative impact of advertising on children’s health and development is a matter of concern,” the delegate stated.

According to the delegate, if the advertisement is aimed at children, right from the appraisal and approval stage, there is attention from experts and authorities for consideration and evaluation. However, there are advertisements that are not directly or completely aimed at children but children can still be affected when receiving the advertisement, so identifying and evaluating the impact is a certain difficulty.

Therefore, delegate Le Van Kham suggested that research should be conducted to more clearly define the content of banning advertising that negatively affects the health and normal development of children; there must be a specialized organization responsible for evaluating and monitoring advertising.

There are different opinions about advertising special products, goods and services.

Commenting on the requirements for advertising content of special products, goods and services (Clause 7, Article 1 of the draft Law), delegate Nguyen Minh Tam (Quang Binh delegation) said that in Clause 2, Article 19 of the 2012 Advertising Law, the Government is assigned to stipulate requirements for advertising content of special products, goods and services.

To implement and specify this content, on November 14, 2013, the Government issued Decree 181/2013/ND-CP detailing a number of articles of the Law on Advertising, which stipulates that the Ministry of Health, the Ministry of Agriculture and Rural Development, and the Ministry of Industry and Trade are responsible for confirming advertising content for special products, goods, and services in the assigned management fields or according to the authority to confirm according to regulations.

According to delegate Nguyen Minh Tam, special products, goods and services are technical and specialized, have a direct impact on human health and can fluctuate over time. Furthermore, special products, goods and services belong to many different fields and the advertising of these products has been regulated by specialized laws.

Therefore, to be flexible and proactive in management, delegates proposed to regulate in the following direction: for contents that have been regulated in specialized laws, they should not be re-regulated but only cited in the draft Law. At the same time, the Government should be assigned to regulate requirements on advertising content for other special products, goods and services when they arise in practice.

The delegate also said that not legalizing the content of the Decree is in line with the direction of the General Secretary and the Chairman of the National Assembly.

Meanwhile, delegate Pham Van Hoa (Dong Thap delegation) agreed to add regulations requiring content of advertisements for special products, goods and services as stated in the draft Law. However, during the implementation process, if there are problems arising from other types of advertisements for goods, it is proposed that the Government be assigned to provide detailed and specific regulations on this content.

Delegate Duong Tan Quan (Ba Ria-Vung Tau delegation) also expressed his agreement with the view that it is necessary to ensure management of special products and services such as cosmetics, functional foods, chemicals, pesticides, etc.

However, delegates suggested that it is necessary to consider listing special products in detail in the draft Law, because these products are often volatile and have highly specialized elements. Instead, flexible regulations should be proposed so that adjustments can be made when necessary.
