Article 11, Circular 32/2023/TT-BCA (replacing Circular 65/2020/TT-BCA) of the Ministry of Public Security stipulates that the Traffic Police team will be assigned a group of officers in disguise (in plain clothes), coordinating with the group of officers to patrol and control openly according to the plan issued by the competent authority as prescribed.
The purpose is to carry out patrolling, controlling and handling violations on assigned routes and areas.
Also in this Article, public patrolling and control combined with disguise (plain clothes) will only be carried out in two cases.
Firstly, using professional technical equipment and means to improve the effectiveness of ensuring order and safety of road traffic.
Second, fight against crime; security, order or complicated road traffic order and safety situation.
The coordination of plainclothes traffic police in patrolling, controlling and handling violations must meet certain conditions such as having a patrol and control plan issued by the competent authority according to regulations. The content of the plan must clearly state the implementation method, force, uniform and communication method.
The Director of the Traffic Police Department; the director of the provincial police; the head of the road and railway traffic patrol and control guidance department; the head of the traffic police department; the head of the district police, according to regulations, decides on wearing police uniforms or plain clothes when patrolling and controlling publicly in combination with disguise.
The disguised officers and the public patrol and control officers in the traffic police team must maintain an appropriate distance to ensure timely and legal handling of violations.
The undercover officers are responsible for directly observing, using professional technical equipment and means to monitor traffic order and safety, detecting violations of road traffic laws and other violations of the law.
When detecting a violation, it must be immediately reported to the patrol and public control department to stop the vehicle, control and handle it according to regulations.
In case of detecting serious violations of road traffic, security, and social order, which if not prevented promptly will cause dangerous consequences, use the People's Police Identity Card to notify and mobilize people to coordinate and immediately prevent the violation.
Then, notify and coordinate with the patrol and public control staff to resolve the violation at the place where it is discovered or bring the violator to the nearest police station for resolution according to regulations.
Thus, it can be seen that although traffic police wear plain clothes, they still have the right to patrol and monitor people who violate alcohol concentration. However, they are not allowed to directly handle violations when they detect them, but must notify and coordinate with the patrol and public control department to handle them according to the provisions of the law, except in cases where serious violations are detected, in which case they are allowed to immediately stop the violation.
