On the afternoon of February 5, on the official social networking sites of Nam An Cosmetic Surgery Hospital Joint Stock Company (Nam An Cosmetic Hospital), a press release was posted stating that the hospital is suing Sen Vang Commercial Advertising Joint Stock Company (abbreviated as Sen Vang Company) in the second lawsuit - demanding that Sen Vang pay back 400 million VND.

According to the press release, Nam An Cosmetic Hospital informed that, with the disputes that have arisen between Nam An Cosmetic Hospital and Sen Vang Company, on February 2, 2024, Nam An Cosmetic Hospital continued to file another lawsuit against Sen Vang in a draft cooperation agreement of 3 billion VND so that the Director of Nam An Cosmetic Hospital can be a judge for the Miss Grand International 2023 (MGI2023) contest, through which, Sen Vang will continue to promote the hospital's brand.
Specifically, Ms. Nguyen Thi Nhu Lan (General Director of Nam An Cosmetic Hospital) said that on March 17, 2023, Nam An Cosmetic Hospital and Sen Vang Company signed a brand promotion contract worth 10 billion VND through the Miss Grand 2023 contest. The hospital is suing Sen Vang for this cooperation in December 2023 because it believes that Sen Vang violated the contract, and the People's Court of Binh Thanh District is handling the case.
“By September 2023, Sen Vang Company will continue to invite Nam An Cosmetic Hospital to cooperate in promoting the brand at the Miss Grand International 2023 (MGI 2023) contest. In particular, Sen Vang Company will carry out brand promotion work for Nam An Cosmetic Hospital through MGI 2023 with businesswoman Nguyen Thi Nhu Lan as the contest's judge. The value of this cooperation is expected to be 3 billion VND, along with a number of other agreements,” said Ms. Lan.

However, according to Ms. Lan's statement in the lawsuit sent to Binh Thanh District People's Court, the two parties planned to sign the contract on September 7, 2023, and because of trust in the partner, Nam An Cosmetic Hospital paid in advance 400 million VND/3 billion VND to Sen Vang Company, before the MGI 2023 competition.

But since the time of the money transfer, there have been many incidents between the parties; and due to doubts about the legality of the MGI 2023 contest, Nam An Cosmetic Hospital has repeatedly requested Sen Vang to provide documents proving that Sen Vang is the Organizing Committee of the contest, whether Sen Vang has the authority to sign a contract with an organization/individual to be the judge of the Miss Grand International 2023 contest or not...
However, according to Ms. Lan, Sen Vang did not provide the above documents for the reason of "keeping information confidential with other individuals and partners and requested the hospital to continue paying while in fact the contract between the parties had not been signed", CEO Nguyen Thi Nhu Lan further explained.
“According to the original draft agreement, if I signed the contract, I would be a judge of the competition, which means I would be able to participate in commenting, evaluating, and selecting contestants; but in reality, on the final night, I was not allowed to perform the role of a judge. I just sat there like a scarecrow,” Ms. Lan was upset and added: “Right after the final night, I also expressed my frustration on my livestreams, not just now,” Ms. Lan emphasized.
Believing that the rights of Nam An Cosmetic Hospital were violated, this time Nam An Cosmetic Hospital continued to sue Sen Vang Company in the second case, requesting the People's Court of Binh Thanh District to force Sen Vang to return to the hospital 400 million VND in principal and interest incurred according to regulations.
Sen Vang Company with the lawsuit related to Miss Grand Le Hoang Phuong
In December 2023, Binh Thanh District People's Court (HCMC) accepted the case of a dispute over a brand promotion contract between the plaintiff - Nam An Cosmetic Hospital and the defendant - Sen Vang Company.
According to the lawsuit, on March 17, 2023, Nam An Cosmetic Hospital and Sen Vang Company signed a brand promotion contract worth 10 billion VND. The content stated that Nam An Cosmetic Hospital, as the host of the Miss Grand 2023 contest, should have the right to "The crowned beauty queen will be the brand ambassador of Nam An Cosmetic Hospital for 2 years".
After that, Ms. Le Hoang Phuong became the beauty queen of the Miss Grand Vietnam 2023 contest.
However, on November 7, 2023, Nam An Cosmetic Hospital discovered that on the Facebook page with a blue tick (the official confirmation stamp provided by Facebook) named "Chiem Quoc Thai" there was a post tagged with the Facebook name "Le Hoang Phuong" related to cosmetic issues. Under this post, the Facebook account "Le Hoang Phuong" commented: "I would like to thank the Doctor for helping me have a perfect beauty and be more confident".
Nam An Cosmetic Hospital believes that Miss Le Hoang Phuong's behavior is promoting the brand of another company operating in the same field as this Hospital. Therefore, this behavior seriously violates the legitimate rights and interests of Nam An Cosmetic Hospital as recorded in the contract and appendix signed with Sen Vang Company.
Since then, Nam An Cosmetic Hospital has filed a lawsuit to terminate the contract, forcing Sen Vang Company to compensate more than 8.6 billion VND (including refunding 80% of the contract value that the plaintiff has paid; penalty for breach of contract in the amount of 8% of the contract value that the plaintiff has paid; compensation for mental damage due to honor and reputation being violated in the amount of 14.9 million VND).
