Accordingly, the City People's Committee requests: for the study of organizing the establishment of District Master Plans: agree with the proposal of the Department of Planning and Architecture in Document No. 372/QHKT-DTVT dated February 3, 2025, allowing the renaming of tasks, projects, planning period and some contents of the "District construction planning to 2030, vision to 2050" (currently implemented according to the provisions of the Construction Law 2014, 2020) to "District Master Plan to 2045" (to comply with the provisions of the Law on Urban and Rural Planning 2024).
At the same time, assign the People's Committees of the districts to continue reviewing and completing the District Master Plan projects until 2045 (based on the volume of District Master Plan projects that have been implemented, limiting the cost increase and avoiding waste). The Department of Planning and Architecture shall conduct parallel appraisal; submit to the City People's Committee for approval of the tasks and District Master Plan projects immediately after the Law on Urban and Rural Planning 2024 takes effect (submit to the City People's Committee for approval in July 2025).
Research on districts with over 50% of natural area belonging to urban development areas (districts: Thuong Tin, Dan Phuong, Me Linh, ...) and districts with National Tourist Areas located entirely within the administrative boundaries of the district (such as My Duc district) does not have to establish a general district plan (according to the provisions of the Law on Urban and Rural Planning 2024), assigning the People's Committees of the districts to settle the consultancy value according to regulations. For the area belonging to the urban development area, a general town plan or urban subdivision plan is established, the remaining area is established as a general commune plan, ensuring compliance with the orientation of the Adjustment of the General Planning of the Capital approved by the Prime Minister in Decision No. 1668/QD-TTg dated December 27, 2024.
For towns, areas within the scope of urban development and remaining functional areas shall comply with the provisions of the Law on Urban and Rural Planning 2024.
Regarding the research on the organization of the preparation of 1/2,000 scale urban zoning plans related to the investment project policy of the Urban Area by bidding to select investors according to the provisions of Clause 3, Article 126 of the 2024 Land Law:
The leaders of the City People's Committee have concluded and directed in Notice No. 474/TB-VP dated October 14, 2024; requesting the Department of Planning and Architecture to urgently study and implement according to Clause 5, Article 3 of the Law on Urban and Rural Planning 2024, guiding the People's Committees of relevant districts to organize the preparation, supplementation and completion of the dossier of the Urban Zoning Plan at a scale of 1/2,000 (for the scope of the proposed urban area investment project on the basis of the approved Urban Zoning Plan at a scale of 1/5,000); at the same time, continue to guide the organization to prepare zoning plans for functional areas (tourism, sports, industrial parks, etc.) inside and outside the urban area to implement the project investment policy according to the bidding method to select investors (if any).
Request the People's Committees of the districts: Dong Anh, Gia Lam, Thanh Tri, Hoai Duc, Dan Phuong to urgently deploy the organization of establishing and adjusting urban zoning plans synchronously, ensuring the conditions and criteria for completing the Investment Project to build districts into districts; report to the Department of Planning and Architecture for appraisal, submit to the City People's Committee for approval in July 2025.
The City People's Committee agrees with the proposal of the District People's Committees on decentralization and authorization to the District People's Committees in organizing the implementation of the contents in sections 1 and 2 above, approving related procedures under the authority of the City People's Committee (excluding the authority to appraise and approve tasks and planning projects) with the requirement to promote a sense of responsibility, ensure quality and fastest progress.
Assign the Department of Planning and Architecture to submit a report and advise the City People's Committee to issue a decision directing the implementation of resolving the above difficulties and problems; report and submit to the City People's Committee before February 15, 2025.
Assign the Department of Natural Resources and Environment to urgently coordinate and complete the survey and measurement records and current terrain maps to serve the organization of the above planning work.
In addition, the Office of the City People's Committee is assigned to preside over and review the contents of authorization of administrative procedures in the field of investment in public investment projects and non-budget investment projects; report and propose to the City People's Committee in February 2025.
