The dispatch stated: Recently, the Secretariat, the Government, and the Prime Minister have issued many documents directing ministries, branches, and localities to synchronously deploy tasks and solutions to combat illegal, unreported, and unregulated fishing (IUU fishing), remove the "Yellow Card" warning, including issuing certificates of origin of exploited aquatic products (SC certificates) at fishing ports, issuing certificates of origin of exploited aquatic products (CC certificates) at local fisheries management agencies (Circular No. 21/2018/TT-BNNPTNT dated November 15, 2018 and Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Ministry of Agriculture and Rural Development).

According to the feedback of some enterprises, in the past, there was a situation where fishing port management units and local fisheries management agencies did not comply with current regulations or applied them mechanically, rigidly, and abused regulations to require additional legal contents that were not yet regulated, causing difficulties in issuing SC and CC certificates for seafood export.

To quickly rectify the above situation, the Prime Minister requests the Minister of Agriculture and Rural Development, Chairmen of People's Committees of coastal provinces and centrally-run cities, and associations, enterprises exploiting, processing and exporting aquatic products to immediately implement the following tasks and solutions:

1- Minister of Agriculture and Rural Development:

Strengthen guidance, training and coaching for localities to properly implement legal regulations in the issuance of SC and CC certificates for exploited aquatic products.

Provide guidance and regular inspections to promptly rectify the phenomenon of issuing SC and CC certificates for exploited aquatic products that are not in accordance with current legal regulations or intentionally misunderstand, request enterprises to provide records and documents that are not specified in Circular No. 21/2018/TT-BNNPTNT and Circular No. 01/2022/TT-BNNPTNT of the Ministry of Agriculture and Rural Development, causing difficulties in issuing SC and CC certificates for aquatic product exports.

Review all regulations related to the organization and issuance of SC and CC certificates; amend inappropriate regulations that cause difficulties and hinder production and business activities in the field of seafood exploitation, processing and export; promptly report to competent authorities to amend and supplement contents beyond their authority.

2- Chairman of People's Committee of coastal provinces and centrally-run cities:

- Strictly organize the issuance of certificates of origin of exploited aquatic products (SC certificates), certificates of origin of exploited aquatic products (CC certificates) with the following specific contents:

+ Direct competent authorities to issue SC and CC certificates in accordance with the provisions of law and instructions of the Ministry of Agriculture and Rural Development; do not require documents and procedures that are not yet prescribed by law.

+ According to authority, review, adjust and supplement regulations to create conditions for fishermen and businesses to maintain production and business, ensure social security and develop local socio-economy.

+ Regularly organize inspections and supervision; strictly handle organizations and individuals who violate and intentionally cause difficulties and troubles for people and businesses.

+ Disseminate and popularize legal regulations on combating IUU fishing so that fishermen understand and fully comply.

- Continue to thoroughly handle the situation of "3 no's" fishing vessels according to the requirements and deadline in Official Dispatch No. 111/CD-TTg dated November 4, 2024 of the Prime Minister on focusing on implementing urgent tasks and solutions, focusing on combating illegal, unreported and unregulated (IUU) fishing, preparing to welcome and work with the 5th Inspection Delegation of the European Commission; Strengthen control of the transfer of exploited aquatic products at sea, strictly handle violations according to regulations.

3- Associations, enterprises processing and exporting seafood:

- Fully comply with regulations on granting SC and CC certificates; ensure the establishment and storage of records on tracing the origin of exploited aquatic products in accordance with the provisions of law.

- Coordinate with local authorities to support and propagate fishermen to fully comply with regulations on combating illegal fishing.

The Ministry of Agriculture and Rural Development is assigned to inspect, urge, monitor, synthesize and report to the Prime Minister the results of the implementation of this Official Dispatch.
