BBK - Through the work of supervising the implementation of the law on the management of public land associated with public assets in Bac Kan province by the Provincial People's Council, in the recent past, it has been shown that sectors and localities have strengthened management according to the provisions of the law. However, the management of public land associated with public assets still has many limitations and inadequacies.

However, the issuance of land use right certificates (LURCs) and the adjustment of land changes have not been carried out promptly and fully; the management of public land and public assets is sometimes and in some places not strict; the situation of encroachment on public land still occurs and has not been thoroughly resolved.
According to the report of the Provincial People's Committee, from 2020 to March 31, 2023, 789 land use right certificates were granted to 198 land-using organizations with an area of 179.65 hectares. In general, the management and use of organizations are in accordance with land use planning and plans; basically using the correct boundaries and purposes; land recovery, land allocation, land lease, and land use purpose conversion are carried out in accordance with regulations.
According to statistics from districts and cities, there are currently 351 land plots of agencies and public service establishments that have not been granted land use right certificates. Of which, Bach Thong district has 74, Cho Don 72, Ba Be 69, Na Ri 59, Pac Nam 33, Ngan Son 21, Cho Moi 13, Bac Kan city 10.
Currently, agencies and units have basically been arranged with suitable offices and facilities to serve professional work with a total of 1,343 houses and land. The number of houses and land within the scope and subject to rearrangement and handling according to regulations is 2,539; the number of houses and land for which rearrangement and handling plans have been approved is 2,105, of which 1,955 have been completed according to the approved plan (reaching 92.8%). There are currently 434 houses and land that have not yet developed rearrangement and handling plans to submit to competent authorities for approval, especially village cultural houses and some schools.
In addition, through monitoring, it is shown that violations of road traffic safety corridors are still common, some national and provincial highways have business activities encroaching on the road, illegally using the road corridor, especially on some routes of National Highway 3, DT.259B, DT.258, DT.258B. Regarding the land area associated with industrial park infrastructure, Thanh Binh Industrial Park currently has a total area of 153.8 hectares, with a total of 14 enterprises and investors, of which 08 projects are operating, 03 projects are building factories; 02 new projects have been approved for investment but have not been allocated land and 01 project is temporarily suspended. The total area of land recovered and cleared for investment in construction of technical infrastructure in phase I is 62.3 hectares, of which 29.1 hectares of land has been allocated to investors to implement the project; Land used for construction of shared technical infrastructure (in addition to leased industrial land) is 15.5 hectares; recovered land not yet put into use: 17.7 hectares...

The results of the monitoring work show that local Party committees and authorities at the grassroots level have not been really determined in directing the implementation of legal regulations on land and public property management. The plans for rearranging and handling houses and land have been approved and changed and supplemented but are not comprehensive, some of which are not linked to planning, land use plans and construction plans. The coordination between competent agencies, investors and local authorities is not really close, as shown in the handover of land records after the project is completed and put into use.
The Provincial People's Council's monitoring delegation recommended that the Ministry of Transport hand over to Bac Kan province the compensated but unused area of the National Highway 3 and National Highway 3B upgrading project. The Provincial People's Council considered and issued a Resolution on strengthening the management of public land associated with public assets. The Provincial People's Committee directed the review and statistics of land plots of agencies and public service units that have not been granted land use right certificates, classified and had plans and solutions to completely resolve outstanding cases; reviewed housing and land facilities to adjust and supplement plans for rearrangement and handling in accordance with regulations, avoiding waste of public assets and associated with land use planning and plans. Strengthen specialized inspection and examination of land and public asset management and use, promptly detect and completely handle acts of land encroachment, improper use of public assets, and improper use of regulations.../.
