Ministry of National Defense introduces draft Law on Management and Protection of National Defense Works and Military Zones

On the morning of May 17, the Ministry of National Defense held a press conference to introduce the draft Law on Management and Protection of National Defense Works and Military Zones, chaired by Lieutenant General Nguyen Van Duc, Director of the Propaganda Department, General Department of Politics - Spokesperson of the Ministry of National Defense and Major General Luu Quang Vu - Deputy Director of the Department of Operations, General Staff, Member of the Drafting Committee of the Law project.

Also attending the press conference were Major General Tran Duc Thuan, Standing Member of the National Assembly's Committee on National Defense and Security; Colonel Pham Van Hung, Deputy Director of the Political Department of the General Staff and Colonel Dang Dinh Tan, Deputy Chief of Office of the General Staff of the Vietnam People's Army.

Speaking at the opening of the press conference, Lieutenant General Nguyen Van Duc emphasized the urgency of developing the Draft Law on Management and Protection of National Defense Works and Military Zones in the new context, aiming to overcome the shortcomings and limitations of the Ordinance on Management and Protection of National Defense Works and Military Zones issued in 1994.

The Ministry of National Defense has established a Drafting Committee for the Law Project consisting of 36 members, headed by Senior Lieutenant General Nguyen Tan Cuong, Chief of the General Staff, Deputy Minister of National Defense.

The Draft Law on Management and Protection of National Defense Works and Military Zones consists of 6 Chapters and 34 Articles, built on 4 policy groups, including:

Policy 1: Complete regulations on defining the scope of protection of national defense works and military zones and the content of management and protection of national defense works and military zones.

Policy 2: Management and protection regime for restricted areas, protected areas, safety belts, ammunition depot safety belts, technical safety corridors of military antenna systems of defense works and military zones.

Policy 3 : Conversion of use, demolition, relocation of defense works and military zones.

Policy 4: Policy for localities, agencies, organizations, households, individuals and areas affected by the requirements of management and protection of national defense works and military zones.

The basic contents of the draft Law include: Scope of regulation; explanation of terms; principles of protection of defense works and military zones; State policies in management and protection of defense works and military zones; classification and grouping of defense works and military zones.

Management of defense works and military zones, including: Contents of management of defense works and military zones; establishment of management records of defense works and military zones; use, preservation, maintenance of defense works and military zones, conversion of purpose of use of defense works and military zones; demolition, relocation of defense works and military zones; statistics, inventory of defense works and military zones; organization of management of defense works and military zones.

Protection of national defense works and military zones, including: Contents of protection of national defense works and military zones; determination of the scope of protection of national defense works and military zones, regimes for restricted areas, protected areas, safety belts of national defense works and military zones, safety belts of warehouses, ammunition, technical safety corridors of military antenna systems; Handling of works, architectural objects, management of land and water use within the scope of protection of national defense works and military zones; forces protecting national defense works and military zones;

Duties and powers of the force protecting national defense works and military zones under the Ministry of National Defense; duties and powers of the force under the Ministry of Public Security coordinating to participate in protecting national defense works and military zones; duties and powers of the force under agencies, organizations and localities assigned to protect national defense works and military zones; building safe units and safe areas.

Rights and obligations of organizations, households and individuals and regimes, policies and funding to ensure the management and protection of national defense works and military zones, including: Rights and obligations of organizations, households and individuals in the management and protection of national defense works and military zones; regimes and policies for forces performing the task of managing and protecting national defense works and military zones; regimes and policies for localities, organizations, households and individuals; funding to ensure the management and protection of national defense works and military zones.

State management in the management and protection of national defense works and military zones, including: Responsibilities of the Government; responsibilities of the Ministry of National Defense; responsibilities of the Ministry of Public Security; responsibilities of ministries, ministerial-level agencies, government agencies, and other central agencies; responsibilities of People's Councils and People's Committees at all levels; responsibilities of the Vietnam Fatherland Front and its member organizations.

Speaking at the press conference, Major General Tran Duc Thuan, Standing Member of the National Assembly's Committee on National Defense and Security, said: The Draft Law on Management and Protection of National Defense Works and Military Zones was developed on the basis of the Ordinance on Management and Protection of National Defense Works and Military Zones, which has been implemented for 28 years.

The implementation of the Ordinance in recent times has revealed a number of points that are not consistent with the reality in the new context and situation. The National Assembly's Committee on National Defense and Security highly agrees on the necessity of developing a Law on Management and Protection of National Defense Works and Military Zones to carry out the tasks of national defense, security, and protection of the country early and from afar.

As planned, the Draft Law on Management and Protection of National Defense Works and Military Zones will be submitted to the National Assembly for discussion at the 5th Session of the 15th National Assembly, opening on May 22.
