Kinhtedothi-The draft law unifies the management of cadres and civil servants from the Central to local levels, without distinguishing between commune-level cadres and civil servants and central and provincial-level cadres and civil servants, ensuring proper implementation of the Party's policy on interconnectivity in cadre work.


The Ministry of Home Affairs has just completed and sent out a draft proposal for comments on the draft revised Law on Cadres and Civil Servants. The draft law is expected to be submitted to the National Assembly at the upcoming 9th Session.

The Draft Law was developed based on the conclusions of the Politburo and the Secretariat on the implementation of research and proposals to continue to reorganize the apparatus of the political system and the policy of reorganizing administrative units at all levels and building a 2-level local government organization model (provincial and grassroots levels, not district level).

Notably, the Draft Law amends regulations related to cadres and civil servants when organizing two-level local governments, including provincial and grassroots levels, in which a chapter on commune-level cadres and civil servants in the current Law on Cadres and Civil Servants has been removed.

From there, the Draft Law unifies the management of cadres and civil servants from the central to local levels, without distinguishing between commune-level cadres and civil servants and central and provincial-level cadres and civil servants, ensuring proper implementation of the Party's policy on interconnectivity in cadre work; reviewing regulations on authority to ensure conformity with the 2-level local government organization model, accordingly, not continuing to stipulate the authority of the district-level People's Committee and the chairman of the district-level People's Committee in the Draft Law.

The Draft Law stipulates transitional provisions to unify the management of the current communal-level cadres and civil servants with the cadres and civil servants in the political system, in order to ensure continuity in cadre work so as not to affect the normal operations of people and businesses immediately upon implementing the two-level local government model.

Specifically, the Draft Law stipulates that commune-level cadres and civil servants according to the provisions of the 2008 Law on Cadres and Civil Servants (amended and supplemented by the law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees in 2019) from the effective date of this law are under the payroll of provinces and centrally-run cities.

Accordingly, cadres and civil servants are ranked according to the salary scale and grade corresponding to the job position (VTVL) assigned to them if they meet the standards and conditions required by VTVL; recruitment, use and management are carried out according to the Government's regulations on recruitment, use and management of civil servants.

In case of not meeting the standards and conditions required by VTVL, the competent authority shall consider and decide on streamlining according to the provisions of law at the time of streamlining.

At the same time, the Draft Law amends regulations related to the management and use of cadres and civil servants to serve as a basis for screening, restructuring, and improving the quality of the team when implementing the arrangement and streamlining of the organizational apparatus.

Accordingly, the State will implement a mechanism for managing cadres and civil servants according to VTVL, taking VTVL as the center in the management and use of cadres and civil servants.

At the same time, the provisions in the draft law demonstrate strong innovation in the work of recruitment, training, promotion, appointment, rotation, transfer, and evaluation of cadres and civil servants in a practical direction, for finding people, on the basis of specific, measurable products.

In addition, the Draft Law adds a separate chapter regulating the content of VTVL; adds regulations to distinguish VTVLs that must conduct recruitment and VTVLs that can be allowed to sign contracts to perform the duties of civil servants, creating flexibility in the use of human resources from outside.

The draft law also adds regulations on examination to implement a mechanism for screening staff according to the principle of competition, with entry and exit, promotion and demotion to resolve the situation of avoidance, pushing, procrastination; the mentality that once in the State, it is safe, "lifelong civil servant status", and the elimination mechanism is not strong enough. From there, it ensures the building of a team of experts, quality, with enough virtue and talent to serve the Party, the country and the People.

At the same time, the Draft Law completes regulations on attracting and promoting talented people in public service activities to meet requirements, aiming to institutionalize the principle of implementing the public-private partnership mechanism on human resources in accordance with the spirit of the resolution to attract the maximum number of experts, managers, business administrators... to work in agencies in the political system.
