On the afternoon of September 24, the National Assembly Standing Committee gave opinions on the draft Law on Employment (amended).

New regulations on part-time jobs for students

Notably, the latest draft law submitted to the National Assembly Standing Committee proposed new regulations on part-time employment of students studying in formal education programs.

Accordingly, employees who are students studying in formal education programs and are of working age according to the provisions of this draft law are allowed to work according to the provisions of the law on labor.

The salary of students is paid based on the agreement between the employee and the employer but must not be lower than the minimum hourly wage.

Students who work part-time are responsible for notifying the educational institution.

According to the draft law, employers are responsible for employing students in accordance with labor laws. Educational institutions and families are responsible for monitoring and supporting student workers during their work.

Previously, the draft revised Employment Law, which was put out for consultation in June and July, proposed that students could work no more than 24 hours per week, an increase of 4 hours compared to the draft law that was put out for consultation in March.

Many reforms of unemployment insurance policy

Previously, presenting the Government's proposal on the draft Law on Employment (amended), Minister of Labor, War Invalids and Social Affairs Dao Ngoc Dung said the draft law has many contents to reform unemployment insurance policies.

Accordingly, the bill adds the subjects of participation to be employees who have signed a labor contract with a term of 1 month or more (currently 3 months or more).

Part-time workers whose monthly salary is equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions.

Unemployment insurance contributions are also flexibly regulated in the direction that employees contribute a maximum of 1% of their monthly salary. Employers contribute a maximum of 1% of the monthly salary fund of employees participating in unemployment insurance.

The State supports up to 1% of the monthly salary fund for unemployment insurance contributions of employees participating in unemployment insurance and is guaranteed by the central budget.

The bill also amends unemployment insurance regimes. Specifically, employers are supported when there are economic reasons, changes in structure and technology as prescribed in the Labor Code; natural disasters, fires, enemy attacks or dangerous epidemics or when implementing decisions of competent state agencies on relocation or reduction of production and business locations...

Mr. Dung stated in his summary that the unemployment insurance support policy for workers is currently very limited, almost only for unemployment cases. Meanwhile, the maintenance of training, retraining, and skill conversion is either non-existent or very low.

He pointed out that the recent policy of spending only 3 million VND on vocational training is not enough. Along with that, the work of consulting and job transactions is also inadequate...

According to Minister Dung, the conversion, training and job development previously carried out through the National Employment Fund have not really been effective.

Therefore, this draft law is designed to make it easier for businesses and people to access unemployment insurance policies as well as provide training, fostering, and improving vocational skills to maintain employment for workers.

Reporting on the review of the bill, Chairwoman of the Social Committee Nguyen Thuy Anh said that the standing committee requested the drafting unit to supplement the impact assessment and at the same time have solutions to ensure feasibility when expanding the subjects participating in unemployment insurance.

In addition, it is necessary to clarify the mechanism for handling late payment and evasion of unemployment insurance.
