A first-year student studying at the University of Economics and Law (Ho Chi Minh City National University) has just received an order to call up citizens for military service, so his family had to apply for a temporary leave of absence.

Over the past few days, Ms. Nguyen Thi Anh, mother of Ngo Quang Nguyen - a first-year full-time student majoring in economic mathematics at the University of Economics and Law (Ho Chi Minh City National University), has been busy contacting the school to ask for support in completing procedures for her son to postpone his military service so he can continue studying.
"I don't understand why I can't postpone military service"
Ngo Quang Nguyen (born in 2005) is a permanent resident of Dong Hoa Ward, Di An City, Binh Duong Province. According to his family, in 2023, due to incorrect application, Nguyen was admitted to the Automotive Engineering Technology Department of Ho Chi Minh City University of Agriculture and Forestry, a major he did not like. After enrolling, Nguyen felt that the major was not suitable for him, so he decided to retake the exam.
In 2024, Nguyen took the competency assessment exam of Ho Chi Minh City National University and scored 823 points and was admitted to the Department of Economic Mathematics (majoring in data analysis) of the University of Economics and Law. Nguyen then dropped out of Ho Chi Minh City University of Agriculture and Forestry to enroll in the University of Economics and Law.
In August 2024, Nguyen received an invitation to join the military. On August 27, 2024, Nguyen applied for a student certificate from the University of Economics and Law to prove that he was studying and submitted it to the local authorities, but it was not accepted.
In October 2024, this student received a medical examination certificate for military service. On December 2, 2024, the Dong Hoa Ward Military Command sent an invitation to citizen Ngo Quang Nguyen to complete his military service records.
"On January 13, my son received orders to join the army immediately, so he did not have time to submit an application for a temporary leave of absence from school. Therefore, I had to go to school to submit an application for a temporary leave of absence on his behalf.
My husband and I work hard, we only have one child, Nguyen, and he is a very good student. We have known for a long time that if you are in college, you can postpone your military service, but we don't understand why my son is not allowed to do so," Ms. Anh wondered.
A representative of the University of Economics and Law confirmed that Ngo Quang Nguyen is a first-year full-time student, majoring in economic mathematics, specializing in data analysis at the school. Nguyen's academic performance is very good, at the end of the first semester his cumulative average score was 8.21 - classified as excellent.
Semester 2 of the 2024-2025 school year Nguyen registered for six subjects and is studying. In addition to studying, this student regularly and actively participates in extracurricular activities organized by the faculty/school.
"We were really surprised when Nguyen's mother came to the school to apply for a leave of absence on behalf of her son because Nguyen had already enlisted in the army and was in the barracks. We also did not understand why Nguyen was not allowed to defer his military service because he was studying at a regular university at a member school of Ho Chi Minh City National University.
Because according to Article 30 of the 2015 Law on Military Service, which stipulates the age of military service, Nguyen will be eligible for a temporary deferment from military service," he said.
Due to course change
Speaking with Tuoi Tre, Mr. Tran Ngoc Sang, commander of the Dong Hoa Ward Military Command, said he had reported to the chairman of the ward Military Service Council and the standing committee of the Di An City Military Service Council to have a specific written response if Ngo Quang Nguyen's family had any questions.
"According to the Law on Military Service, Ngo Quang Nguyen's case is no longer eligible for a deferment of military service because he has already studied a training program at one school and is now studying at a second school. This is a legal provision and we are only following the law," Mr. Sang explained.
Meanwhile, according to lawyer Nguyen Van Hau - Vice President of the Ho Chi Minh City Bar Association, based on the information, it can be determined that Ngo Quang Nguyen sent to the Military Command of Dong Hoa Ward, Di An City, Binh Duong Province two student confirmation papers in 2023 and 2024 with two different schools. Nguyen's application for temporary deferment of military service submitted to the Military Command of Dong Hoa Ward in 2023 is different from that in 2024.
The 2015 Law on Military Service stipulates that military service will be deferred for citizens who are receiving regular university training at a higher education institution, with the condition that it is during the duration of one training course of one training level.
According to current standards, a regular university training course will last four years. Cases such as studying for a second university degree or having to extend the study time such as failing a subject will not be considered eligible for deferment of military service according to point g, clause 1, article 41 of the 2015 Law on Military Service.
Only deferment is allowed if studying at Ho Chi Minh City University of Agriculture and Forestry
Lawyer Nguyen Van Hau commented: "Regarding Ngo Quang Nguyen's case, because in 2023 this student submitted to the Dong Hoa Ward Military Command a confirmation letter from Ho Chi Minh City University of Agriculture and Forestry, the Military Command recognized the training course in which Nguyen was temporarily deferred from military service as following the confirmation letter from Ho Chi Minh City University of Agriculture and Forestry, which applies to the 2023-2027 course.
In 2024, Nguyen submitted to the Military Command of Dong Hoa Ward a confirmation from the University of Economics and Law stating that the training course had been changed to 2024 - 2028. Current legal regulations do not stipulate changes in training courses, so according to the initial registration, Nguyen will only be considered for a temporary deferment of military service if he continues to study at Ho Chi Minh City University of Agriculture and Forestry until completing the 2023 - 2027 course.
