On the afternoon of September 6, delivering a speech directing and concluding the first national conference to implement the Laws and Resolutions of the 15th National Assembly, National Assembly Chairman Vuong Dinh Hue said that in the first half of the term, the National Assembly and the 15th National Assembly Standing Committee issued 1,010 documents, including 23 laws, 101 resolutions of the National Assembly, 4 ordinances and 882 resolutions of the National Assembly Standing Committee.

Through monitoring and supervision by the National Assembly, the Standing Committee of the National Assembly, the Committees of the National Assembly, the reports of the Standing Committee of the National Assembly, the Government and the presentations at the Conference, it can be seen that the Government, the Prime Minister, Ministries, branches and localities have proactively, resolutely and synchronously implemented many solutions to implement the Law and Resolution of the National Assembly.

However, according to the National Assembly Chairman, the implementation of the Laws and Resolutions of the National Assembly and the Standing Committee of the National Assembly still has many shortcomings and limitations: The organization and implementation of a number of Laws and Resolutions is still slow.

Focus - 6 laws will take effect from 2024 but there is no implementation plan yet

In particular, among the laws passed at the 5th Session, there are 6 laws that will take effect from January 1, 2024 and July 1, 2024, but there is still no implementation plan, while this is very important and necessary content to plan the work to be done, resources to implement and assign responsibilities for implementation, ensuring timely and effective implementation of laws and resolutions from the time they take effect.

The situation of backlog and slow issuance of detailed regulations has not been resolved. In some cases, the National Assembly Resolution was passed to meet urgent practical requirements, but the detailed regulations were issued slowly, reducing the significance, effectiveness and efficiency of the solutions decided by the National Assembly.

Some documents are not of guaranteed quality, and have to be revised, supplemented or suspended from implementation shortly after being issued due to being unsuitable for practice or having shortcomings, causing difficulties and hindering development.

Meanwhile, the work of reviewing legal documents in some ministries and branches has not received due attention. Some documents with conflicting, overlapping and inappropriate content have also been slow to be processed.

The handling of responsibilities of organizations and individuals with violations in the drafting and promulgation of documents is not timely and not commensurate with the nature and level of violations.

According to the National Assembly Chairman, the above situation has both objective and subjective causes, but the subjective cause is the main one. First of all, it is because the heads of some ministries, branches and localities have not fully promoted their responsibilities and have not paid due attention to the work of building and perfecting institutions and organizing law enforcement in the fields and areas under their responsibility.

There is still a situation of pushing things around, not daring to do things, fear of making mistakes, and avoiding responsibility by a number of officials and civil servants. The Government has not yet promptly identified and strictly handled the responsibilities of organizations and individuals in allowing the situation of delay and debt in issuing documents detailing the implementation of the Law and Resolution, and issuing documents with illegal content...

From now until the end of the term, the workload of the National Assembly, the Government and agencies is very large and many new issues may arise that need to be handled.

Prioritize 9 key tasks

The National Assembly Chairman requested the Government, agencies of the National Assembly, the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, the State Audit... and relevant agencies and organizations at the central and local levels to focus on prioritizing the following tasks to promote the effective implementation of the Laws and Resolutions of the National Assembly:

Firstly, continue to thoroughly grasp the Party's guidelines and policies in the 13th National Congress Documents, the Central Committee's resolutions and conclusions, especially Resolution 27 of the 6th Central Committee Conference, 13th tenure and Conclusion 19 of the Politburo. Tighten discipline, enhance discipline and responsibility in the organization of law enforcement and resolutions of the National Assembly, especially the responsibility of heads of agencies, organizations and units.

Second, the Government needs to further promote its role and responsibility in organizing the implementation of the Constitution, laws, and resolutions of the National Assembly; focus on directing strongly, ensuring resources and necessary conditions for law enforcement; review and promulgate under its authority or direct ministries and ministerial-level agencies in their respective fields to promptly promulgate plans to implement laws and resolutions passed by the National Assembly.

Third, there must be more drastic solutions to overcome the backlog and slow issuance of detailed regulations and guidance on the implementation of laws and resolutions; at the same time, focus on improving the quality of legal documents, ensuring the constitutionality, legality and consistency of documents issued by the Government, Prime Minister, Ministers, Heads of ministerial-level agencies and local authorities.

Fourth, seriously and urgently review the system of legal documents as required in the Resolution of the 5th Session of the 15th National Assembly, promptly detect regulations that have arisen with problems, obstacles, contradictions, overlaps, and inadequacies during implementation to amend and supplement according to authority or propose amendments, supplements, and promulgation of new legal documents, and report to the National Assembly on the review results at the 6th Session (October 2023).

Fifth, promote decentralization and reasonable delegation of power along with strengthening inspection, supervision and monitoring; promptly and effectively overcome the situation of shirking, evasion and lack of responsibility among some cadres and civil servants, and strictly handle violations.

Sixth, focus on completing the law and ordinance making program in 2023 and 2024 according to Resolution 89 of the National Assembly, in conjunction with continuing to thoroughly grasp and strictly implement the remaining legislative tasks of the term, solutions, and requirements for innovation, and improving the quality of law making activities according to Conclusion No. 19 of the Politburo and Plan 81 of the National Assembly Standing Committee.

Seventh, continue to enhance the proactiveness and responsibility of the Standing Committee of the National Assembly and the agencies of the National Assembly in monitoring, urging and supervising the Government and relevant agencies and organizations in implementing laws and resolutions of the National Assembly; focus on monitoring the promulgation of detailed regulations, considering this an important task that needs to be carried out regularly.

Eighth, the National Assembly delegations and National Assembly deputies continue to step up supervision of law enforcement and implementation of laws and resolutions of the National Assembly in localities; pay attention to supervising the promulgation and organization of implementation of documents detailing the implementation of laws and resolutions of the National Assembly.

Ninthly, People's Councils and People's Committees at all levels, especially in localities implementing the pilot according to the National Assembly's resolutions, continue to enhance proactiveness, responsibility, creativity and flexibility in organizing the implementation of legal regulations at the local level... .
