According to the indictment of the Provincial People's Procuracy, at about 7:30 p.m. on March 23, 2024, after coming home from drinking, A Nhai went to his brother A Nhat's house in Plei Ro Hai I village and argued with his father A Nhen.
Not wanting to argue with his son, Mr. A Nhen left, then A Nhai went home, took a machete, cursed and demanded money from his biological mother, Y Ranh. Seeing that, A Kan (neighbor) woke up A Nhat, who was sleeping because he was drunk, and told him to beat A Nhai.
A Nhat got up and went out to the yard and saw A Nhai arguing with his mother and smashing his parents' house with a machete. A Nhat told A Kan to go to the kitchen to get a knife because he saw A Nhai holding a machete. A Kan took the knife and gave it to A Nhat. When A Nhai challenged them, they both stabbed each other with knives.
As a result, A Nhai was stabbed in the left hip by A Nhat, penetrating the abdomen and puncturing the left kidney, leading to acute blood loss and subsequent death.
A Nhat's actions directly violated the inviolable right to human life and caused social disorder. The trial panel sentenced A Nhat to 15 years in prison for the crime of "Murder" as prescribed in Point a, Clause 1, Article 123 of the Penal Code.
When A Kan saw A Nhai cursing and destroying things, he did not stop him but instead woke A Nhat up and told him to beat A Nhai; gave A Nhat a knife to stab A Nhai, leading to his death. Therefore, A Kan's actions constituted the crime of "Murder" as an accomplice to A Nhat. The jury sentenced A Kan to 13 years in prison for this crime.
