On the morning of March 26, Supervisory Delegation No. 51 of the Provincial People's Council led by Mr. Tran Phu Hung - Permanent Vice Chairman of the Provincial People's Council had a working session with the Provincial People's Committee on law enforcement in mineral management and exploitation in Dak Lak province, period 2020 - 2024.

Working with the Supervisory Delegation, on the side of the Provincial People's Committee, there was comrade Nguyen Thien Van - Vice Chairman of the Provincial People's Committee and leaders of relevant departments, branches and localities.
According to the report of the Provincial People's Committee, the Planning of Dak Lak province for the period of 2021-2030, with a vision to 2050, has been approved by the Prime Minister in Decision No. 1747/QD-TTg dated December 30, 2023. The plan for exploration, exploitation and use of minerals is integrated into the Provincial Planning, including: 196 areas of land for leveling; 157 areas of stone for common construction materials; 42 areas of sand for construction materials; 35 areas of clay for brick and tile production; 01 area of land for construction materials production; 01 area of lead and zinc mine; 01 area of quartz mine; 07 areas of peat.
In the period of 2020 - 2024, the Provincial People's Committee has issued, extended and adjusted 32 mineral exploitation licenses; of which, there are 15 construction sand exploitation licenses and 22 construction stone exploitation licenses. In addition, the Ministry of Natural Resources and Environment has issued 01 license to exploit granite for tiling in Buon Ngo area, Hoa Phong commune, Krong Bong district.
Licensed mines are all small and medium-sized, the main minerals are stone for common construction materials, sand for common construction materials, clay for brick production, paving stones and construction site leveling soil. Exploitation is by open-pit mining technology, mining system by layer (preparing soil and rock and loading), direct transportation by car. Products from mineral exploitation in the province mainly serve the construction needs of people, socio-economic development projects, national key projects in the province, no export. The value of mining industry production from 2020 - 2024 is 988.95 billion VND, estimated at an average of 0.186% in the total product structure.

In general, the state management of minerals in the province has been implemented in accordance with the Central Government's directive documents, closely following the actual situation and conditions of the province. The Provincial People's Committee has issued many documents directing departments, branches and localities to strengthen the management of mineral activities, implement measures to protect unexploited minerals, prevent and clear illegal mineral activities, inspect and examine mineral activities; strictly handle acts of illegal exploitation, trading, transportation and consumption of minerals in the area according to their authority and legal regulations. The Chairman of the District People's Committee must be responsible to the Chairman of the Provincial People's Committee if illegal mineral exploitation continues in the area under their management.

Every year, following the direction of the Government Inspectorate and the Ministry of Natural Resources and Environment, the Provincial People's Committee directs the Department of Natural Resources and Environment to organize inspections and examinations of compliance with laws on natural resources and the environment, including the mineral sector, for organizations and individuals operating in the mineral sector in the province. From 2020 to present, 06 inspections and examinations of compliance with laws on natural resources and the environment have been carried out for 39 mineral exploitation units; at the same time, coordinate with the General Department of Geology and Minerals of Vietnam to inspect compliance with laws on minerals for 22 mineral exploitation units in the province.
In general, mineral exploitation units in the province comply well with the provisions of the law on minerals, land, environment and water resources.
However, through inspection, some units still have shortcomings in their operations, such as not submitting periodic reports on mineral exploitation activities; exploiting minerals outside the permitted exploitation boundaries; not collecting statistics through weighing stations; not installing weighing stations at the place where raw minerals are transported out of the mine to monitor and store related information; not keeping books, documents, and related materials to determine actual exploitation output; exploiting minerals beyond capacity...
Based on the results of the inspection and examination, the Department has sanctioned and advised the Chairman of the Provincial People's Committee to issue 25 decisions on administrative sanctions against 25 organizations, with a total fine of VND 1,444.6 million, including: fines in the field of minerals: VND 1,194,000,000; fines in the field of land: VND 247,000,000; fines in the field of water resources: VND 3,600,000. In addition, based on the proposal of the State Audit, the Provincial Tax Department, the Provincial Police and the General Department of Geology and Minerals of Vietnam, the Department of Natural Resources and Environment has sanctioned and advised the Chairman of the Provincial People's Committee to issue 14 decisions on administrative sanctions in the field of minerals against 14 units with a total fine of VND 3,940,000,000.

Concluding the working session, Comrade Tran Phu Hung - Permanent Vice Chairman of the Provincial People's Council, on behalf of the Supervisory Delegation, acknowledged the achievements of the Provincial People's Committee in leading and directing departments, branches, units and localities in the management and exploitation of minerals in Dak Lak province, period 2020 - 2024. However, through supervision and field surveys in a number of localities, agencies and units, it was found that in the process of organization and implementation, there were still certain shortcomings and limitations. It is recommended that the Provincial People's Committee and departments, branches, units and localities recognize and promptly direct corrections in the coming time to effectively implement legal policies on mineral exploitation in the coming time.
The monitoring delegation requested departments, branches and localities to continue to promote the dissemination of laws on minerals, especially in places where mineral exploration and exploitation activities take place; strengthen state management, guide the effective implementation of regulations and have coordination regulations between agencies, units and localities; protect and strictly manage unexploited minerals; focus on inspection and examination, limit the loss of resources and state budget...
