On the afternoon of June 9, the National Assembly discussed in the hall the draft Resolution on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly and People's Councils (amended).

Promote the responsibility of leaders in early and remote prevention

Delegate Mai Thi Phuong Hoa (Nam Dinh delegation) said that Clause 2, Article 8 of the draft Resolution stipulates: "It is strictly forbidden to use or promise to give, donate, or support money, property, or material benefits to lobby, entice, or bribe National Assembly deputies and People's Council deputies in taking a vote of confidence or voting for confidence."

Delegates proposed to add to this clause the phrase "or non-material benefits" to make it more complete and cover all cases, for example: giving rewards, proposing to give titles and prizes; election, appointment to positions; raising exam scores; promising to send people to school, etc.

In addition, since “money and property” are also material benefits, to express it more accurately, the delegate proposed to add the phrase “other material benefits”. The delegate proposed to amend this paragraph to: “It is strictly forbidden to use or promise to give, donate, support money, property or other material benefits or non-material benefits to lobby, entice, bribe, influence…”.

Delegate Hoa added that in the summary report on the implementation of Resolution No. 85 of the Delegation Work Committee, it was stated that in 2018, in the People's Councils at the commune level nationwide, a total of 84,234 people were voted on for confidence; of which, 186 people had over 50% of the total number of delegates rating low confidence (accounting for 0.22%)...

The delegate said that, according to the report, the results of the vote of confidence above have relatively closely reflected the economic and social situation and the operation of the local government apparatus. At the same time, this is close to the practical capacity, the cultivation and training of moral qualities, lifestyle, and working style of the officials who were voted for.

“The report also did not record any cases of taking advantage of the vote of confidence to cause internal disunity. However, it is also necessary to prevent the occurrence of internal disunity in these units,” delegate Hoa shared.

According to the delegate, in a large group, this phenomenon is unlikely to occur, but in the People's Council at the commune level, in a few localities with relatively dense clan and village characteristics, the above possibility can still occur.

Because the number of People's Council delegates of a commune is not large, just a group of people from a clan who make up the majority in the People's Council of the commune, control or manipulate the votes, can take advantage of the vote of confidence to reduce the prestige of others, causing division and disunity within the organization.

Therefore, the delegate proposed to add the following idea to Article 7 of the draft Resolution: "The head and collective leadership of the agency or unit must be responsible in case of taking advantage of the vote of confidence or vote of no confidence to cause internal disunity."

At the same time, in the implementation organization, it is necessary to do a good job of grasping the situation and ideological work to prevent early and from afar the abuse of taking a vote of confidence and voting for confidence to cause internal disunity.

Low-trust officials should be removed from the planning soon.

Participating in the discussion, delegate Nguyen Anh Tri (Hanoi delegation) highly appreciated the National Assembly Standing Committee for amending this resolution to promptly institutionalize the Party's guidelines, perfect and synchronize the legal system.

"The resolution has many fundamental and progressive changes that meet the aspirations of the people and voters," said the delegate.

Going into some specific contents, delegate Tri was concerned about the regulations on the consequences for those who are voted for and voted for. Clause 1, Article 12 stipulates: those who have a low number of votes of confidence from 1/2 to 2/3 can immediately resign or will be voted for at that session or the nearest session.

According to the delegate, officials with low credibility should be promptly considered for removal from the planning, resignation, dismissal or assignment to other lower-ranking jobs, without waiting for the end of their term.

“I boldly propose that the National Assembly should hold a vote of confidence at that session. Because this is a matter of personnel organization, the longer it takes, the more difficult it will be, and negativity will easily occur,” delegate Tri analyzed.

In addition, the Hanoi delegation also stated that the draft Resolution does not mention the group of people who have just taken office or were appointed mid-term.

Delegates believe that officials who have been in office for 100 days or more can be included in a vote of confidence, because this period of time is enough to evaluate an official when they take on a certain task.
