Continuing the program of the 9th Extraordinary Session, on the afternoon of February 13, the National Assembly worked in the Hall, discussing the draft Law on Promulgation of Legal Documents (amended).

At the meeting hall, delegate Nguyen Thi Viet Nga (Hai Duong) stated that removing the right to issue legal documents of commune-level authorities is very suitable to reality.

Because currently, although empowered by law, most commune-level authorities rarely issue normative documents, and in many localities, commune-level authorities do not issue normative documents.

Agreeing with the strong innovations in the mechanism for ensuring resources for law-making work stipulated in Articles 69 and 70 of the draft Law, including special treatment of human resources, financial resources, and investment in modernization to enhance the application of digital technology and artificial intelligence, delegate Cao Thi Xuan (Thanh Hoa) said that this is a worthy investment for a legal system that meets the 12 criteria set forth by the Politburo in Conclusion 119-KL/TW on democracy, professionalism, science, timeliness, feasibility, efficiency, transparency, accessibility, ease of application, time and cost savings, speeding up progress, and improving quality.

During the discussion session, many delegates were interested in the issue of social criticism, consultation, and comments on policies and draft legal documents and expressed their approval of the regulation that the Vietnam Fatherland Front and socio-political organizations conduct social criticism on draft legal documents.

Proposing the need to study and supplement the criticism of the Fatherland Front and socio-political organizations right in the policy-making process, delegate Chu Thi Hong Thai (Lang Son) said that the draft Law has separated the policy-making process and the process of drafting legal documents.

The policy-making process (stipulated in Section II on policy-making) does not stipulate that the Vietnam Fatherland Front and socio-political organizations criticize policies but only participate in giving opinions.

This is not consistent with the Notice of Conclusion of the National Assembly Standing Committee on the draft Law in Notice No. 4927 of the Secretary General of the National Assembly on Social Criticism and Policy Consultation; Regulations on social supervision and criticism of the Vietnam Fatherland Front and socio-political organizations issued together with Decision No. 217/QD-TW of the Politburo on the subjects of social criticism in Clause 1, Article 9; and in Directive No. 18-CT/TW dated October 26, 2022 of the Secretariat on promoting the role, improving the quality and effectiveness of social supervision and criticism of the Vietnam Fatherland Front and socio-political organizations.

Therefore, the participation of the Vietnam Fatherland Front and socio-political organizations right from the stage of proposing and formulating policies ensures that those policies fully reflect the will and aspirations of the people as well as harmonize the legitimate rights and interests of the State, people and businesses, contributing to preventing and combating corruption, waste, negativity, and group interests in the policy-making process, and bringing policies into life quickly and effectively.

Concluding the session, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the discussion atmosphere in the Hall was very lively, focused, democratic, intellectual, with a high sense of responsibility. The content of the speech was both comprehensive and comprehensive on all issues mentioned in the draft Law, and specific, practical, giving direct comments on the contents and provisions in the articles and clauses of the draft Law.

According to the Vice Chairman of the National Assembly, the National Assembly Standing Committee has assigned the Secretary General of the National Assembly to urgently organize a full synthesis of the opinions discussed in groups and in the Hall, send them to National Assembly deputies and relevant agencies for study and for responsible agencies to receive and explain.

The National Assembly Standing Committee will closely coordinate with the Government to direct the agency in charge of the appraisal to coordinate with the agency in charge of the drafting and relevant agencies to seriously absorb all opinions of the National Assembly deputies to continue to perfect the draft Law with the highest quality before submitting it to the National Assembly for consideration and approval./.
