The Draft Law on Science, Technology and Innovation still has many limitations.

Many opinions say that the draft Law on Science, Technology and Innovation needs more breakthrough adjustments, focusing on simplifying commercialization procedures.

The Draft Law on Science, Technology and Innovation was published by the Ministry of Science and Technology for public comments. The Draft Law consists of 14 Chapters and 83 Articles, including key and important contents inherited from the 2013 Law on Science and Technology.

The draft has some outstanding points such as: supplementing regulations on special public research and development organizations operating in fields prioritized by the State for investment; supplementing regulations on autonomy mechanism for public research and development organizations;

Supplementing regulations on individuals engaged in scientific research and technology development in public science and technology organizations to participate in establishing and operating enterprises to commercialize research results created by the science and technology organizations of which they are members; simplifying the steps for approving science and technology tasks using the state budget, reducing the time for approving tasks (proposing, identifying, selecting, etc.).

However, some opinions say that the draft Law does not clearly state the mechanism and incentives for universities to establish enterprises; science and technology enterprises in universities, especially with commercialized products, spin-offs or business cooperation with research and development (R&D) from universities.

The draft Law needs to have more innovative adjustments, focusing on strong tax incentives and more flexible financial support for science, technology and innovation enterprises.

At the same time, it is necessary to simplify procedures for commercializing research results; build a national innovation ecosystem with the participation of businesses; improve science, technology and innovation human resources policies to attract talent.

The draft Law needs to encourage and create conditions for scientists to commercialize their scientific research products through the establishment of science and technology enterprises or university-affiliated enterprises.

At the discussion to collect comments on the Draft Law on Science, Technology and Innovation organized by Ho Chi Minh City National University, Prof. Dr. Nguyen Thi Canh (University of Economics and Law) said that keeping the phrase "Innovation" as the name of the draft Law would not be appropriate because innovation is the result of research and application of science and technology.

In addition, the regulations on finance and investment in science and technology in Chapter IV of the draft Law only mention the minimum budget expenditure for science and technology of 2% of the state budget. However, it does not cover the average investment in science and technology from different sources, which accounts for what percentage of the country's GDP. In which, how much is from the budget, how much is from mobilizing non-state social resources, from which policies can be made to mobilize social resources.

Prof. Dr. Phan Thi Tuoi (University of Science and Technology) assessed that the draft Law still has many loose points, does not have new points as expected and lacks coverage for all organizations and individuals working in science in the current period of rapid and modern scientific development.

Specifically, it is necessary to define what “open science” is in Article 9 on the State’s policy on open science. This article stipulates that “Intellectual property rights to shared research results belong to the individual or organization that creates the results or as prescribed by law”, however, there are currently no relevant regulations on this issue.
