Speaking with Thanh Nien reporter, lawyer Ha Thi Kim Lien (Phan Law Vietnam Law Firm) said that participating in advertising for gambling activities is a prohibited act according to the provisions of Clause 1, Article 7 and Clause 1, Article 8 of the 2012 Advertising Law.
"Any form of advertising, whether direct or indirect, for gambling activities can be handled according to the law," the lawyer emphasized.
A certain sensitivity is required.
Master of Psychology Pham Anh Hoa emphasized that consumers are also affected in their lives and finances if they are influenced by bad advertisements from celebrities, especially those related to gambling. This expert assessed: "Their motivations and goals in life gradually fade away due to attractive advertisements that certain artists perform illegally. Because they are caught up in, using services or buying such products causes their spending and financial planning to be severely affected. When things related to the economy go downhill, all other problems are also dragged down. Obviously, that is a huge consequence of incorrect advertisements from artists, especially those related to gambling or services disguised as gambling."
Therefore, when accepting to participate in advertising activities, celebrities need to set their own principles for checking product quality, service quality and need to have a certain sensitivity towards disguised gambling services.
In the event that artists appear in illegal gambling advertising clips, it is necessary to verify and clarify their level of involvement in this activity to determine the extent of the violation (if any). Any individual who advertises gambling may be subject to administrative sanctions according to Point a, Clause 2, Article 33 of Decree 38/2021/ND-CP, specifically: "A fine of VND 70,000,000 to VND 100,000,000 for one of the acts of advertising goods and services prohibited from trading according to regulations". In addition, the competent authority will also force the person to remove, delete the advertisement or recall the printed newspaper or magazine products with advertisements related to illegal gambling activities.
