
Question: "From February 14, 2025, will teachers who teach extra classes in schools not be allowed to collect money from students? What is the responsibility of the Principal in managing extra classes and teaching?", Nguyen Thu Ha (Nghe An).
Regarding this issue, LAW LIBRARY answers as follows:
Pursuant to Clause 1, Article 5 of Circular 29/2024/TT-BGDDT, regulations on extra teaching in schools are as follows:
Article 5. Extra teaching and learning in schools
1. Extra teaching and learning in schools must not collect fees from students and is only for students who register for extra classes in each subject as follows:
a) Students whose final semester subject results are unsatisfactory;
b) Students selected by the school to nurture excellent students;
c) Final year students voluntarily register to review for entrance exams and graduation exams according to the school's educational plan.
2. The school shall organize for students who are subject to the provisions of Clause 1 of this Article to write an application for additional study by subject in each grade level (according to Form No. 01 in the Appendix attached to this Circular).
3. Based on the number of registered students, the school develops a plan to organize extra teaching for each subject in each grade.
Thus, from February 14, 2025, teachers teaching extra classes in schools are not allowed to collect money from students and are only allowed to teach extra classes for students who register for each subject as prescribed above.
Regarding the Principal's responsibility in managing extra learning and teaching, according to Article 13 of Circular 29/2024/TT-BGDDT, the Principal's responsibility is stipulated as follows:
1. Organize extra teaching and learning in schools according to the provisions of this Circular and other relevant legal provisions.
2. Manage teachers who are teaching at school when participating in extra-curricular teaching outside of school to ensure compliance with the provisions in Clause 3, Article 6 of this Circular; coordinate to monitor and inspect extra-curricular teaching activities outside of school of teachers who are teaching at school.
3. Be responsible to the direct management agency for the quality of extra teaching and learning in schools; manage and use funds for organizing extra teaching and learning in schools according to regulations.
4. Handle according to authority or recommend competent authorities to handle violations of regulations on extra teaching and learning.
5. Receive and handle opinions, recommendations, and wishes of students and parents regarding extra teaching and learning before and during the implementation process.
