Regulations on policies to attract and employ talented people to work in state agencies

According to the Decree, the subjects of application include:

1. Cadres, civil servants (including commune-level cadres and civil servants), public employees;

2. Excellent graduates, talented young scientists;

3. Experts, managers, business administrators, leading scientists are Vietnamese or foreigners.

Standards and conditions for applying policies to attract and promote talented people

1. Cadres, civil servants and public employees must meet the following standards and conditions:

a) Have strong political will; good political and moral qualities; clear background; healthy enough to perform duties; have the desire to contribute and serve the Fatherland and the People; be dynamic, creative, dare to think, dare to do, dare to take responsibility for the common interest;

b) Take the lead in advising and proposing to competent authorities policies and solutions that bring high efficiency, breakthroughs, and turning points in performing tasks and public services; have research works or proposals that are applied and bring high value and efficiency in strategic and key sectors and fields of the country or locality;

c) Meet other specific standards and conditions as prescribed by ministries, branches, central and local agencies.

2. Excellent graduates and talented young scientists who meet one of the following criteria and conditions:

a) Students who graduated with honors from a domestic university or graduated with honors or higher from a prestigious university in the world, recognized as equivalent in terms of diplomas and certificates according to the provisions of law, within the age range specified in Article 1 of the Youth Law at the time of application submission;

b) Students who graduated with honors from a domestic university, within the age range specified in Article 1 of the Youth Law at the time of application submission, and have achieved one of the following personal achievements:

Won third prize or higher in one of the provincial-level excellent student selection competitions, won an encouragement prize or higher in the national excellent student selection competitions, or a Certificate of Merit or higher in the international excellent student selection competitions in one of the natural sciences (math, physics, chemistry, biology, informatics) and social sciences (literature, history, geography, foreign languages) during high school;

Won third prize or higher in a national or international science and technology competition during high school or university;

Won third prize or higher in an individual Olympic competition in one of the following subjects: mathematics, physics, chemistry, mechanics, informatics or other majors during university study recognized by the Ministry of Education and Training.

c) People with a doctorate, level II specialist doctor, level II specialist pharmacist in medicine or pharmacy at a domestic educational institution, within the age limit prescribed by the Government on the use and promotion of individuals working in science and technology at the time of application submission.

3. Experts, managers, business administrators, and leading scientists who are Vietnamese or foreigners and meet one of the following criteria and conditions:

a) PhD and post-doctoral graduates from prestigious training institutions around the world;

b) People who have been participating in teaching, scientific research, and technology transfer at research facilities, programs, international cooperation projects on science and technology, or research departments of prestigious enterprises abroad, in specialized fields suitable for scientific and technological tasks performed in Vietnam;

c) Experts, managers, and business administrators who have worked at leading enterprises and organizations in Vietnam and internationally, have extensive professional experience and outstanding achievements in their fields of operation, suitable for the requirements of performing economic, scientific, technological development tasks or key fields in Vietnam;

d) For foreign experts, managers, business administrators, and leading scientists, in addition to the above regulations, they must also meet other conditions as prescribed by Vietnamese law.

Policy to attract talented people

Priority policy in recruiting civil servants and public employees

The Decree clearly states that ministries, branches, central and local agencies must prioritize staffing to recruit excellent graduates and talented young scientists. The head of the agency managing civil servants and public employees is responsible for determining specific job positions that require talented people at the agency, organization, and unit under their management.

Recruitment of excellent graduates and young scientists who meet the prescribed standards and conditions for civil servants and public employees is carried out through examination. The content, form, order and procedures of examination are carried out in accordance with the provisions of the law on civil servants and public employees.

Initial recruitment incentive

Excellent graduates and talented young scientists, when recruited as civil servants or public employees, shall receive 100% of their salary during the probationary period. At the same time, they shall receive an additional allowance equal to 150% of their current salary coefficient within 5 years from the date of the recruitment decision, except for the case specified in Clause 3, Article 6 of this Decree. The additional allowance shall not be used to calculate the contribution to compulsory social insurance, health insurance, and unemployment insurance (for civil servants).

Based on the local budget balance capacity, the Provincial People's Committee shall submit to the People's Council of the same level for consideration and decision on supplementary support policies for excellent graduates and talented young scientists when recruited to work in agencies, organizations and units under their management.

Training and development policy after recruitment

Excellent graduates and talented young scientists, after being recruited as civil servants and public employees, will be given the following conditions by their managing and employing agencies and units to participate in studying and improving their qualifications:

Priority is given to training to become a scientist, leading expert in the field suitable for the professional work. To be assigned to participate in training programs to develop basic and general knowledge of the industry, profession, and field of work suitable for the development orientation.

Be assigned to participate in domestic and international training courses for programs suitable for the industry, profession, field suitable for development orientation and other training and development courses suitable for the characteristics of the industry, field, and locality.

Priority and conditions are given to participate in training and fostering in political theory, state management and specialized knowledge to meet leadership and management standards according to planned positions; professional standards of civil servant ranks and professional titles of public employees.

Priority policy in placement and use after recruitment

Excellent graduates and talented young scientists, after being recruited into civil servants and public employees, will be given favorable conditions in arrangement and employment by the agencies, organizations and units that manage and employ them as follows:

Agencies, organizations and units with management and use authority are responsible for reviewing and selecting planning for leadership and management positions in all areas of work at the central and local levels.

Scientific staff with research capacity are focused on training to become leading scientists and experts in the fields assigned to preside over scientific research topics and projects from the ministerial and provincial levels and above.

To be considered for promotion to senior specialist or equivalent if within 5 years from the date of recruitment, the quality is assessed and classified as good performance or higher, of which 2 years or more are assessed and classified as excellent performance.

Based on the needs and political tasks of the agency or unit and on the basis of work results, after 1 to 2 years of recruitment, if the task is completed well, the cadre will be considered and appointed as a leader or manager from the department level and equivalent at the district level or higher (according to decentralization), even if the cadre is not a party member (except for advisory bodies of the Party Committee and Party organization).

Priority policy for experts, managers, business administrators, leading scientists

Based on the need to use high-quality human resources in strategic and key national fields, ministries, branches, central and local agencies are allowed to sign labor contracts with experts, managers, business administrators, and leading scientists who are Vietnamese or foreigners to carry out specific tasks, projects, and plans to work in agencies, organizations, and units under their management.

The selection of the form of labor contract, the content of the agreement in the labor contract and the remuneration level for experts and leading scientists are decided by the heads of ministries, branches, central and local agencies based on the work requirements, capacity, contributions of experts, managers, business administrators, leading scientists and the funding source to implement policies for talented people of ministries, branches, central and local agencies.

Experts, managers, business administrators, and leading scientists who are Vietnamese, of working age according to the provisions of the law on labor, if they wish to work long-term at agencies, organizations, and units in the political system, will be considered by competent authorities for admission to civil service and public employees and will receive an additional allowance equal to 300% of their current salary (including: salary according to rank, position, title, professional title and salary allowances according to the provisions of law). The additional allowance is not used to calculate the contribution to compulsory social insurance, health insurance, and unemployment insurance (for public employees).

Support policy for experts, managers, business administrators, leading scientists who are Vietnamese living abroad or foreigners

The competent authority facilitates the simplification of documents and issuance of visas, residence permits, and work permits in Vietnam.

Family members of experts, managers, business administrators, and leading scientists (including father, mother, wife or husband, biological children, and adopted children under 18 years old) are facilitated and supported by local authorities, management agencies, and competent agencies in terms of procedures when seeking employment and enrolling and studying at educational and training institutions in Vietnam.

Experts, managers, business administrators, leading scientists and their family members are granted multiple-entry visas or temporary residence cards with a duration corresponding to the period of signing the labor contract with the agency or unit as prescribed in this Decree.

Policy of rewarding talented people

Recommend and recognize talented cadres, civil servants and public employees

Every year, based on the prescribed standards and conditions, the collective Party Committee, leaders of agencies, organizations and units employing cadres, civil servants and public employees shall have a written recommendation of cadres, civil servants and public employees who meet the standards and conditions for competent agencies to consider and select as talented cadres, civil servants and public employees.

The head of the agency with authority to manage cadres, civil servants and public employees shall establish a Talent Selection Council to examine and evaluate the compliance with standards and conditions of talented cadres, civil servants and public employees.

Additional allowance policy for talented officials, civil servants and public employees

Talented cadres, civil servants and public employees are entitled to an additional monthly allowance equal to 150% of their current salary from the date of the recognition decision by the competent authority. The additional allowance is not used to calculate the contribution to compulsory social insurance, health insurance and unemployment insurance (for civil servants).

Policy on arrangement and use of talented cadres, civil servants and public employees

Talented cadres, civil servants and public employees are given priority in arrangement and use by the managing and using agencies and units as follows:

Priority selection when considering appointment to leadership or management positions or appointment to senior expert positions; in special cases, the competent authority will consider and decide on planning, age, and duration of holding equivalent positions when considering appointment.

Be sent to study experience, conduct research, and exchange science domestically or abroad related to the assigned expertise and profession at least once a year; receive full payment of expenses according to regulations during the period of study experience, research, and exchange science, except in cases where the law provides otherwise.

Be proactive in proposing to participate in international training courses, conferences and seminars to promote capacity and talent, meeting job requirements.

Be fully reimbursed for expenses as prescribed when going on business trips or attending seminars domestically and abroad when directly related to the implementation of assigned programs, projects, and scientific tasks.

Honor, reward

Based on the contributions of talented people to the development of agencies, organizations, sectors and fields, the competent authority managing civil servants and public employees shall decide within its authority or propose to the competent authority to award medals, badges, emulation titles, commemorative medals or other forms of rewards according to the provisions of law; the ratio shall not be applied in considering the awarding of emulation titles or rewards for talented people.

Talented people are proposed by agencies, organizations and units to be honored in ceremonies and honoring programs of ministries, branches, localities and news agencies and press related to the industry and field of work.

In addition to the rewards in kind and in cash paid from the Emulation and Reward Fund according to the provisions of the law on emulation and rewards, the head of the agency, organization, or unit managing and employing talented people decides to pay rewards from the annual bonus fund.

This Decree comes into force from January 1, 2025.
