Kinhtedothi-On the morning of October 28, the National Assembly discussed in the hall the report of the Supervisory Delegation and the draft Resolution of the National Assembly on the results of the thematic supervision of "the implementation of policies and laws on real estate market management and social housing development from 2015 to the end of 2023".
Implementing about 800 social housing projects
Chairman of the National Assembly's Economic Committee Vu Hong Thanh - Deputy Head of the National Assembly's Supervisory Delegation presented the National Assembly's Supervisory Delegation's Report on the implementation of policies and laws on real estate market management and social housing development from 2015 to the end of 2023. He stated that this is a difficult supervision topic. The content and scope of supervision are wide because the real estate market and social housing are related to many different sectors and fields; related to the management responsibilities of many ministries, branches and localities.
At the same time, during the monitoring period, there were many changes in policies and laws; the scope of monitoring not only includes newly implemented projects but also many projects that have been and are being implemented before, real estate transactions are very diverse, leading to information and data that cannot be fully collected and clearly separated.
Through monitoring, it is shown that in the period of 2015-2023, the real estate market has made progress in terms of scale, type, quantity, form of capital mobilization and participating entities; creating a large amount of material facilities for society, helping production, business and service sectors develop and improve living conditions for all classes of people; making an important contribution to socio-economic development, economic growth of the country and contributing to the implementation of social security policies, gradually meeting the housing needs of the people.
According to the monitoring team's report, in the period 2015-2023, the scale of added value of the real estate business (at current prices) increased gradually each year, from about 83,000 billion VND to more than 121,000 billion VND, with an average growth rate of 2.72%/year. The land area planned for urban development increased annually compared to the total natural area; the urbanization rate increased from 30.5% in 2010 to about 40% in 2020.
By the end of the monitoring period, there were approximately 3,363 commercial housing and urban area development projects that had been and were being implemented with a land use scale of approximately 11,191 hectares; 413 industrial parks were established with a total industrial land area of approximately 87,700 hectares.
Regarding social housing, about 800 projects have been implemented with a scale of 567,042 units, of which: 373 projects have been completed with a scale of 193,920 units; 129 projects have started construction with a scale of 114,934 units; 298 projects have been approved for investment with a scale of 258,188 units.
Procedures for registering to buy social housing are still cumbersome.
In addition to the achieved results, the real estate and social housing market still has many shortcomings, inadequacies, unsustainable development, imbalance of supply and demand; real estate prices are still high compared to the income of the majority of people; many urban areas are abandoned; management of mini apartments still has many shortcomings; there is no effective solution to handle and resolve old apartment buildings that do not ensure living conditions for people; many projects are stuck and slow to be implemented. New types of real estate face many legal problems, lacking clear and specific regulations.
The implementation of the Housing Development Program and Plan, the Investment Project to build at least 1 million social housing apartments for low-income people and industrial park workers (2021-2030 period) has not met the requirements, most localities have not completed the social housing development target. Some localities with many industrial parks and industrial clusters have developed the form of building boarding houses for workers to rent by households and individuals, but have not ensured construction standards and regulations, thus not ensuring safety, living and working conditions for low-income workers and laborers.
Basically, localities have paid attention to allocating land funds for social housing construction when making and approving plans and when approving investment policies for commercial housing projects, they must allocate 20% of land funds for social housing. However, many localities have not yet allocated independent land funds for social housing development; social housing development mainly depends on the 20% land fund in commercial housing projects, but implementation still has many shortcomings and obstacles.
In addition, although the forms of implementing social housing support policies are diverse, rich and suitable, the review of subjects and verification of conditions for enjoying social housing policies (not having a house, must reside in a province with social housing, income not subject to personal income tax) still have many complicated and cumbersome procedures; some regulations are unclear and lack specificity, coordination between local departments, branches and sectors is not tight, causing difficulties in implementation, and the implementation time is prolonged...
The monitoring team believes that the above-mentioned shortcomings and limitations are due to many reasons, both objective and subjective, but the subjective reasons are the main ones. In addition to the reasons due to the legal regulations in both the law and the documents detailing the implementation of the law on real estate market management and social housing development in the period of 2015-2023, it is largely due to the limitations in the organization of implementation at all levels, sectors and localities, with the fear of making mistakes and the mentality of tenure.
Review and remove difficulties to harmonize supply and demand
The monitoring delegation noted that in 2023-2024, the Government submitted to the National Assembly for consideration and approval many important Law projects directly related to real estate market management and social housing development such as the 2024 Land Law, the 2023 Housing Law, and the 2023 Real Estate Business Law. The Government, ministries and branches have urgently issued documents detailing the Laws. Localities are also urgently completing guiding documents according to their authority.
At the same time, the National Assembly and the Government are reviewing and finalizing many other related draft laws on urban and rural planning, investment, planning, fire prevention and fighting, geology and minerals, notarization, etc.
The monitoring delegation recommended that the National Assembly consider passing a Resolution on continuing to improve the effectiveness and efficiency of implementing policies and laws on real estate market management and social housing development based on monitoring results, focusing on tasks and solutions to implement newly issued laws and continue to improve relevant policies and laws, and improve the effectiveness of organizing the implementation of policies and laws.
At the same time, continue to improve legal regulations related to real estate market management and social housing development, creating a legal basis for the real estate market to develop healthily, safely, and sustainably, meeting people's housing needs.
The monitoring delegation also recommended that the Government, ministries, branches and localities continue to review the existing shortcomings and limitations of policies and laws in real estate market management and social housing development that have been identified, and have synchronous and specific solutions to overcome them; towards developing a safe, healthy and sustainable real estate market. Diversify products for the real estate market, harmonize supply and demand, increase real estate supply in accordance with people's income, meet housing needs and ensure social security.
