Regulations on specific measures on agricultural land use

The 2024 Capital Law strongly decentralizes power to the Hanoi People's Council, stipulates specific measures on agricultural land use. Apply investment incentives on land rent, water surface rent, and corporate income tax rates. Attract strategic investors to the high-tech agricultural sector and develop high-tech zones.

Institutionalize the tasks set out in Resolution No. 19-NQ/TW on agriculture, farmers, and rural areas to 2030, with a vision to 2045, and Resolution No. 15-NQ/TW, Clause 1, Article 32 of the Capital Law 2024, which states: “Developing the capital’s agriculture towards ecological and sustainable agriculture; focusing on the interaction between environmental, economic and social factors to preserve and promote historical and cultural values ​​in agriculture and rural areas; preventing and combating natural disasters, protecting the environment and ecosystems, creating quality products, food safety, and high economic efficiency.”

To achieve the above goal, the 2024 Capital Law stipulates many specific policies to develop agriculture, rural areas, and farmers of the Capital.

Notably, the City People's Council stipulates the scope, subjects, content, and support levels higher than those prescribed or not yet prescribed in documents of superior State agencies on varieties, technology transfer in variety production; technology for preserving and deeply processing agricultural products; application of high technology in agricultural production; development of ecological agriculture combined with experiential tourism; environmental protection activities in production and preliminary processing of agricultural products; development of value chains, product consumption markets; development of collective economy, craft villages, craft villages and human resource training activities in the field of high-tech agriculture, innovative start-up enterprises in the field of agriculture and rural areas.

This regulation aims to encourage the development of ecological agriculture, modern countryside, civilized farmers, strong application of high technology and advanced, modern management technology in agricultural production, while preserving and promoting rural identity, cultural traditions and craft villages; focusing on developing and improving the quality of human resources in the agricultural sector, in which farmers are the subject, the center of the process of agricultural development, rural economy and new rural construction.

Attracting strategic investors into the agricultural sector

In addition, the 2024 Capital Law also strongly decentralizes the City People's Council to regulate specific measures on agricultural land use. Specifically: multi-purpose land use in concentrated agricultural production areas: agricultural land is allocated for construction of works directly serving agricultural production, processing, preservation, display, product introduction, experiential education, and eco-tourism.

The City People's Council is assigned to regulate the conditions, procedures, and processes for granting construction permits, types of works, and the proportion of agricultural land used to build works on agricultural land directly serving agricultural production; the City People's Committee decides to grant construction permits for works directly serving agricultural production in concentrated agricultural production areas. This regulation aims to improve the efficiency of agricultural land use, increase productivity of the entire agricultural production chain from planting, harvesting, preliminary processing, preservation to product consumption.

Regarding the use and exploitation of agricultural land funds in river banks and floating beaches on diked rivers: The City People's Council shall prescribe the forms of use and exploitation of agricultural land funds in river banks and floating beaches on diked rivers for agricultural production, ecological agricultural production, agriculture combined with tourism, and experiential education, ensuring the principle that construction on agricultural land in river banks and floating beaches on diked rivers must be consistent with the flood prevention and control planning of diked rivers, dike planning, construction planning, and other related planning.

On that basis, the City People's Committee decided to allow the use of agricultural land funds on river banks and floating banks on diked rivers.

The Capital Law also stipulates the application of investment incentives on land rent, water surface rent, and corporate income tax rates for projects using high and advanced technology in the fields of environment, climate change response, waste and wastewater treatment; projects to build high-tech agricultural zones, high-tech agricultural projects, and traditional craft village development projects.

Attract strategic investors into the field of high-tech agriculture, develop high-tech zones including high-tech agricultural zones in the city.
