Agree to issue identity certificates to people of Vietnamese origin

According to the National Assembly's Committee on National Defense and Security, granting identity certificates to people of Vietnamese origin will open up a solution for a group of people of Vietnamese origin who wish to have a type of identification document when their nationality is not yet determined, helping them stabilize their lives, have jobs, send their children to school, and ensure their rights in civil transactions.

Specific regulations on conditions for granting identity certificates to people of Vietnamese origin

Reporting on the review of the revised Law on Citizen Identification on the afternoon of June 2, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the Committee agreed to amend the name of the draft Law to the Law on Identification as submitted by the Government, in order to ensure comprehensiveness, completeness, and conformity with the scope of regulation and subjects of application of the draft Law, and with management requirements and exploitation and use in civil, administrative, and judicial transactions of the people.

Regarding identity certificates and management of people of Vietnamese origin, the National Defense and Security Committee agrees with the proposal to add the subject of application to people of Vietnamese origin whose nationality has not been determined.

Accordingly, granting identity certificates to these people will open up a solution for a group of people of Vietnamese origin who wish to have a type of identification document when their nationality is not yet determined, helping them stabilize their lives, have jobs, send their children to school, and ensure their rights in civil transactions.

At the same time, this is also a deeply humane issue, contributing to ensuring the rights of people of Vietnamese origin (including children of people of Vietnamese origin), and disadvantaged people in society, in accordance with the policies of the Party and State.

In addition, there are suggestions to study specific regulations in the draft Law on criteria and conditions for granting identity cards; management of people of Vietnamese origin; clearly defining the competent authority to manage this subject; agencies and organizations authorized to collect, update, store, exploit and use information on people of Vietnamese origin in the National Population Database and Identity Card Database; regulations on the use and validity of identity cards; age for issuing and exchanging identity cards to ensure convenient and proper use.

Consider regulations on showing information about place of birth registration and place of residence on identity cards

Regarding the content shown on the ID card (Article 19), the National Defense and Security Committee basically agrees with the content of this Article to ensure full necessary information for a citizen; at the same time, meet the requirements of administrative reform and e-Government development.

However, it is recommended to continue researching and reviewing each specific content to determine the information shown on the ID card is really necessary, suitable for management requirements and usage purposes, ensuring stability and longevity.

Some opinions suggested considering the regulation of showing information about the place of birth registration and place of residence on the ID card, because in reality, there are many people who do not complete birth registration procedures (especially people in the South born before 1975), so the regulation as in the draft Law will cause difficulties when issuing ID cards to these people.

On the other hand, according to the draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam, the information on the passport is “place of birth”; the Law on Civil Status also stipulates information on “place of birth”. Therefore, it is recommended to study the regulations to ensure consistency.

Meanwhile, according to current regulations, the place of residence can be the place of permanent residence, temporary residence or current residence (in case there is no place of permanent residence or temporary residence). Although this regulation may facilitate some citizens who do not have a place of permanent residence or temporary residence, in reality it causes difficulties for the majority of other citizens when conducting transactions that require determining the place of permanent residence. On the other hand, information about a citizen's temporary residence or current residence is often unstable, so the information recorded on the card will often be inaccurate at the time of the transaction.

Reasonable and feasible procedures for issuing ID cards to people under 14 years old

Regarding people granted ID cards (Article 20), the National Defense and Security Committee basically agreed to add regulations on granting ID cards to people under 14 years old according to demand.

Chairman Le Tan Toi said that this is a new regulation compared to the 2014 Law on Citizen Identification, ensuring the legitimate rights and interests of citizens, especially children under 14 years old; promoting the exploitation and use of the National Population Database, the Identity Database; convenience for many services, such as: medical examination, education, tourism, etc.

Furthermore, the draft Law stipulates that the issuance of ID cards to people under 14 years old is based on demand, and Clause 1, Article 24 stipulates the procedures for issuing ID cards to people under 14 years old, which is reasonable, feasible, and consistent with the general trend that a number of countries are implementing.

However, there are opinions suggesting considering the regulation of adding the subject of ID card issuance to people under 14 years old because it is believed that the need to use ID cards of this group of subjects is very low, transactions are mainly still carried out through parents or representatives.
