On November 27, 2023, the 15th National Assembly officially passed the Law on Identification and it will take effect from July 1, 2024.
So, how will the DNA collection for ID card be done?
At point d, clause 1, Article 16, Law on Identification No. 26/2023/QH15 stipulates the collection of DNA and voice as follows: “Biometric information on DNA and voice is collected when:
- Citizens voluntarily provide or the criminal proceedings agency, the agency managing the person subject to administrative handling measures in the process of resolving the case according to its functions and tasks, if it conducts an expert examination or collects biometric information about the person's DNA or voice, it will share it with the identity management agency to update and adjust the Identity Database.
Citizens are not required to provide DNA when applying for an ID card.
- The criminal prosecution agency and the agency managing people subject to administrative handling measures that have biometric information about people's DNA and voices must transfer it to the identity management agency for updating and adjustment.
Thus, people are not required to provide DNA and voice when applying for ID cards from July 1, 2024. Only when administrative measures are applied and biometric information about people's DNA and voice is required, will the prosecution agency collect and transfer it to the ID management agency for updating.
The Law on Identification, effective from July 1, 2024, also has many new points, including regulations and procedures for issuing identification cards to people aged 14 and over and issuing identification cards to people under 6 years old.
