Speaking at the group, Deputy Hoang Minh Hieu (Nghe An Delegation) said that it is necessary to continue to make improvements and innovations in the work of building and perfecting institutions. Accordingly, it is necessary to first study and amend the methods of law-making to respond more quickly to practical requirements and demands; to change the periodic review and amendment of laws to the review and amendment of laws according to the requirements of life.

“The current traditional way to amend and supplement legal documents is to conduct a preliminary review of the implementation of the law every 5 years, a final review every 10 years, and then conduct a comprehensive amendment of a law. This approach has the advantage that the amendment and supplementation of the law is more comprehensive, based on an overall assessment of the implementation of the law. However, the limitation of this approach is that it delays the amendment and supplementation of inadequacies that have been clearly pointed out in practice,” Mr. Hieu acknowledged.

Mr. Hieu gave an example that the most typical example related to the law-making activities at this session was the shortcomings related to the Mineral Law. Accordingly, in recent years, through meetings with voters, it has shown shortcomings related to the handling of common materials stipulated in Article 64 of the Mineral Law; however, the response from relevant agencies to voters is always to wait for a general amendment to the Mineral Law. This has created bottlenecks and frustrations in the implementation of the law in localities.

Similarly, according to Mr. Hieu, there are inadequacies related to the family deduction level in the implementation of the Personal Income Tax Law but have not been amended or supplemented because the Personal Income Tax Law has not been studied, amended or supplemented in general. Referring to the experience of many countries, it shows that the general spirit in legislative activities in parliaments of countries is to focus on amending and supplementing existing and inadequate issues. A law is only amended in general when there is a change in policy doctrine in that field; in other cases, priority is given to directly and promptly amending and supplementing inappropriate provisions. Therefore, there are laws of countries that are amended regularly, even annually, but still ensure stability in implementation, overcome inadequacies to promote the effectiveness of the identified policy framework.

Mr. Hieu also suggested that attention should be paid to institutional reform activities related to the simplification of administrative procedures. This is one of the bottlenecks that creates barriers to economic and social development. Recent analyses have also shown that prolonged administrative procedures are also one of the reasons that hinder labor productivity growth.

According to the Government Report, the target of increasing labor productivity is one of the targets that has not been achieved for many years. Long administrative procedures and high compliance costs will be a burden for production and business activities.

“For example, earlier this year, when summarizing publishing activities, a publishing house director said that to publish a book, the dossier needs to have nearly 100 signatures, which means the physical time to produce the product is prolonged, reducing labor productivity,” Mr. Hieu said, suggesting that the Government consider simplifying administrative procedures as one of the key tasks in 2024 and the following years. Thereby, it is necessary to continue to have strong solutions to reform administrative procedures, cut unnecessary procedures, research and apply technological solutions to speed up the time to carry out work, thereby contributing to improving labor productivity and promoting socio-economic development.

Sharing the same view, Deputy Ho Thi Kim Ngan (Bac Kan Delegation) said that many Laws were issued in 2016 and 2017 but now there are no detailed regulations. The work of drafting Laws is related to the Government's commitment. When submitting Laws, the dossier must include relevant draft Decrees. However, it is still 7-8 years behind. The delay in issuing documents guiding detailed regulations for implementation makes it very difficult to implement, and it also slows down resources for implementing those policies and mechanisms.

“The story of thrift and anti-waste practices here is related to the process of drafting documents and perfecting institutions. The contents required by the National Assembly must be implemented by the Government according to the Law on promulgation of legal documents. Accordingly, detailed documents must also be effective when the Law comes into effect. This is the desire of officials and voters,” Ms. Ngan said.
