Vice Chairman of Nghe An Provincial People's Committee Le Hong Vinh has just signed a decision to administratively fine Kieu Phat Trading Company Limited (Kieu Phat Enterprise) VND 320 million for 3 violations.
Specifically, Kieu Phat enterprise encroached on agricultural land which is production forest land in rural areas, with a total area of 32,000m2, of which 16,000m2 of production forest land was used to the east of the mine area (adjacent to and extending from landmark M3-M4) in Thung Xan II area, Lien Hop commune (Quy Hop district) to dump waste rock and soil, and product gathering area without being leased land by state agencies.
Using 16,000 mm2 of production forest land to the south of the mine area (adjacent to and extending from landmark MI1-M1), in the above area as mine office, product gathering area and waste dump when the land has not been leased by the state agency.
For the above actions, the People's Committee of Nghe An province fined Kieu Phat enterprise 210 million VND. Forced to restore the original state of the land before the violation and return the encroached land. At the same time, return the illegal profit of 128 million VND.
In the second violation, Kieu Phat Enterprise prepared a statistical report and inventory of remaining mineral reserves in the permitted exploitation area without complete information according to the form prescribed by the Ministry of Natural Resources and Environment.
Specifically, the statistical report and inventory of remaining mineral reserves in the licensed area in 2022 does not contain information on remaining reserves; there is no statistical or inventory data at the time of the report. The statistics and inventory of exploited mineral reserves are not based on the results of updating information and data of the current status map and current cross-section drawings.
For this act, the enterprise was administratively fined 30 million VND.
In addition, Kieu Phat Enterprise was also found to have not fully prepared books, vouchers, documents, and related materials to determine actual annual mining output. For this act, the enterprise was administratively fined an additional VND80 million.
The total amount of fines and illegal profits that Kieu Phat enterprise must pay to the State Treasury of Nghe An province is 448 million VND.
Kieu Phat Trading Company Limited is located in Lien Hop commune, Quy Hop district, Nghe An province, with Mr. Nguyen Van Hien (born in 1970) as the legal representative and director.
Previously, also in September 2024, the People's Committee of Nghe An province also decided to administratively fine Hop Thinh Company Limited, in the small-scale industrial park, Quy Hop town, Quy Hop district, Nghe An province, more than 420 million VND for violations in mineral exploitation activities.
