Responding to this content, lawyer To Bao Long, Hiep Thanh Law Firm, Hanoi Bar Association said that according to the provisions of the law, depending on the case, it will be considered for re-issuance.

Specifically, in Clause 2, Clause 3, Article 36, Circular No. 12 of the Ministry of Transport regulating training, testing, and granting of road motor vehicle driving licenses stipulates:

A person whose driving license is lost, if it is still valid or expired for less than 3 months, will be considered for a re-issuance of a driving license.

The profile includes:

Application for changing (re-issuing) a driving license according to the form prescribed in Appendix 19 issued with Circular 12;

Original documents matching the driver's license (if any);

Driver's health certificate issued by a competent medical facility as prescribed, except for the case of re-issuing an indefinite driving license for classes A1, A2, A3;

The procedure for re-issuing a driver's license can be done online via the National Public Service Portal or directly at the driver's license renewal points of the Department of Transport.

After 2 months from the date of submission of complete documents and payment of fees as prescribed, if the driving license is not detected to be confiscated or processed by competent authorities; the name is in the records of the examination management agency, the driving license will be reissued.

“Within 5 working days from the date of consideration for re-issuance of the driving license, the Department of Transport shall re-issue the driving license and return the license when the driver has completed the fee payment obligation; in case the driving license is not re-issued, a response must be given stating the reason,” said lawyer Bao Long.

In addition, in Clause 3, Article 36, the Circular also stipulates: People whose driving licenses are lost, expired for 3 months or more, whose names are in the records of the testing management agency, and are not currently being confiscated or processed by competent authorities, after 2 months from the date of submitting a complete and valid application as prescribed, must re-take the test for the following contents:

Expired from 3 months to less than 1 year, must retake the theory test according to the provisions at Point a, Clause 4, Article 21, Circular 12;

If the license has expired for 1 year or more, the theory test must be retaken according to the provisions of Point a, Clause 4, Article 21, Circular 12, and driving practice in the form and on the road;

“Thus, based on the above regulations, in case the person applying for re-issuance of a driver's license is still valid or expired for less than 3 months, it is necessary to prepare a dossier including: Application for re-issuance of a driver's license according to the form; original dossier consistent with the driver's license (if any); health certificate of the driver issued by a competent medical facility according to regulations.

After completing the documents, the person requesting to reissue the driver's license must submit the documents to the Department of Transport or can apply online. The driver will have to pay a fee of 135,000 VND/time for reissuing the driver's license. In case of having to retake the theory test for cars of the following categories: B1, B2, C, D, E, F, the test fee is 100,000 VND/time; for those who have to retake the practical test, the fee shown in the picture is 350,000 VND/time and 80,000 VND/time for practicing on the road," said lawyer To Bao Long.
