Land prices are skyrocketing
On November 13, discussing in groups about the Draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights, National Assembly delegate Nguyen Phuong Thuy (National Assembly Delegation of Hanoi) said that land prices are feverish, increasing rapidly, especially after auctions in suburban districts and there is no solution to control them.
In the pilot case of allowing the expansion of agricultural and non-agricultural land (commercial, service...) for commercial housing projects through agreements, delegate Nguyen Phuong Thuy expressed concern that the land price fever would spread, creating barriers for businesses in need of using and accessing land resources.
“In the case of organizations and individuals buying to convert into commercial housing, land prices will increase, making access to land even more difficult. Therefore, the pilot should only be conducted in large urban areas with high demand for housing such as Hanoi and Ho Chi Minh City,” said delegate Nguyen Phuong Thuy.
National Assembly Delegate Ha Sy Dong (National Assembly Delegation of Quang Tri Province) expressed concern that if the pilot is not effective, it will lead to land profiteering, land speculation and land accumulation. This will negatively affect real estate prices.
“Hanoi and Ho Chi Minh City are big cities or localities with many stuck projects, so priority should be given to projects that meet actual needs. At the same time, procedures must also be simple, avoiding the creation of a request-grant mechanism that causes difficulties for investors,” said National Assembly delegate Ha Sy Dong.
Additional forms of land access in commercial housing construction
Meanwhile, National Assembly delegate Tran Hoang Ngan (Ho Chi Minh City National Assembly Delegation) said that the piloting of this policy will have a ripple effect in supporting the country's socio-economic development, especially in removing difficulties in building commercial housing, creating favorable conditions for land users and investors to be proactive in implementing commercial housing projects and urban development projects, contributing to solving the need for residential land and housing for the people.
Explaining at the group discussion session, Minister of Natural Resources and Environment Do Duc Duy said that according to Resolution 18-NQ/TW dated June 16, 2022 of the 13th Party Central Committee "on continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a high-income developed country", land allocation and land lease are carried out through auctions of land use rights and bidding. Therefore, the form of receiving transfer of rights or changing the purpose of land in use is a supplementary form and the Government proposes a maximum of 30% of the land area using this method. The remaining 70% of the project area must be implemented through bidding and auctions according to Resolution 18-NQ/TW. The nature of this pilot land expansion is to supplement the form of land access in commercial housing construction.
In response to delegates' concerns about overlapping with the 2024 Land Law, the Minister of Natural Resources and Environment said that the Government has designed an additional provision to avoid this overlap in the draft resolution. That is, any case that has been regulated by the 2024 Land Law is excluded from the scope of regulation by this resolution.
According to the program, the National Assembly will discuss in the hall the Draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights on November 21, and pass it at the end of the 8th Session.
