Today, October 30, the National Assembly held a group discussion on the Draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the form of public-private partnership, the Law on Bidding, and the Resolution on piloting the handling of evidence and assets during the investigation, prosecution, and trial of a number of criminal cases. Delegate Hoang Duc Thang, Deputy Head of the Delegation of National Assembly Deputies of Quang Tri province, participated in the group discussion.

Regarding the Resolution on piloting the handling of evidence and assets during the investigation, prosecution and trial of a number of criminal cases, delegate Hoang Duc Thang said that current criminal proceedings are posing major obstacles and challenges in handling evidence and assets in cases, especially economic corruption cases. In reality, there are assets of great value that are confiscated, temporarily detained and not handled for a long time, causing a huge waste of resources from these assets and affecting the direct interests of businesses, individuals and organizations.

In addition, in economic corruption cases, the risk of asset dissipation and asset transfer during the period from the discovery of the crime to the prosecution and trial is very high, and many cases have no assets left to execute the judgment by the time of sentencing. Therefore, the issuance of a resolution is an urgent requirement to resolve the above issues.

The scope of the resolution refers to criminal cases and incidents under the direction of the Central Steering Committee on corruption prevention and control. According to delegates, determining such a scope is appropriate, can focus on ensuring implementation and is convenient in summarizing the pilot to move towards legalization.

Delegate Hoang Duc Thang also gave some opinions on the Draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.

Regarding the content of amending and supplementing the Law on Planning, delegates proposed that planning be evaluated periodically every 3 years compared to 5 years as stipulated in the draft, the reason being that for a long time there have been many "suspended" plans that have not been implemented, causing waste of capital, land and other resources. Furthermore, the 2024 Land Law stipulates that after 3 years of land use planning being announced but not implemented, it will be handled, so the 3-year period should be stipulated to be consistent with the provisions of the Land Law on land use planning.

Regarding amendments and supplements to a number of articles of the Law on Investment under the public-private partnership model, delegates proposed clearly defining the authority of the Provincial People's Committee and Provincial People's Council in deciding on investment policies for PPP projects under local management to avoid overlap when the law comes into practice.
