Monitoring policy access on compensation, support and resettlement of Cho Moi expressway

The monitoring delegation worked with the People's Committee of Cho Moi district.

The Cho Moi - Bac Kan expressway construction investment project was just started by the Ministry of Construction in early March 2025. The section passing through Cho Moi district has a total length of about 22.9 km. In Cho Moi district, there are a total of about 865 households, individuals and 5 organizations within the affected area in Thanh Thinh, Nong Ha, Thanh Mai, Thanh Van communes (of which 110 households had their residential land recovered and their houses relocated). Up to now, 865/865 households and individuals have been counted.

The estimated number of households in need of resettlement in Cho Moi district is 104, of which Thanh Thinh commune has 85 households; Thanh Mai commune has 7 households; Thanh Van commune has 12 households. It is expected to be arranged in 3 resettlement areas, including Ban Ang village, Thanh Thinh commune; An Tho village, Thanh Van commune; Trung Tam village, Thanh Mai commune, with the district People's Committee as the investor. Currently, the detailed planning project is being completed to submit to the agencies for appraisal and approval.

The district's difficulty is the compensation for graves. Currently, the People's Committee of Cho Moi district has approved the compensation and support plan (phase 1) for graves, in which over 3.7 billion VND/207 graves/105 households have been paid. After receiving the compensation, people have moved about 189 graves; 12 graves cannot be moved yet. Currently, they are continuing to direct the specialized departments and the People's Committees of the communes to speed up the appraisal of the documents when the Land Fund Development Center of Bac Kan city transfers the documents to determine the origin of land, assets, etc. in the communes within the project's clearance area.

At the monitoring session, Cho Moi district recommended that the provincial departments and branches pay attention to shortening the minimum time allowed for appraisal or giving opinions on the project to meet the requirements and progress of the project. It is recommended that the Provincial Traffic Project Management Board allocate funds for the project in a timely manner according to the set progress and plan. The Department of Agriculture and Environment advises on issuing economic and technical norms to prepare state budget estimates for land valuation in the province, to have a basis for preparing estimates and approving estimates to hire a private unit to perform specific land valuation work to serve the site clearance work for resettlement areas in Thanh Thinh, Thanh Mai and Thanh Van communes. Propose the Department of Construction to advise the Provincial People's Committee on the policy of supporting the assets of houses and constructions serving the daily life of households and individuals built on non-residential land within the area of ​​site clearance and constructions affected by high and low differences when the State reclaims land for project construction. Provide a mechanism to support relocation for households whose graves are located close to the reclaimed boundary...

After supervising Thanh Mai, Thanh Thinh, Thanh Van, Nong Ha communes and working with the District People's Committee, the Chairman of the Provincial Vietnam Fatherland Front Committee assessed that the units had done a good job of disseminating and implementing policies to the people. The Chairman of the Provincial Vietnam Fatherland Front Committee requested that in the coming time, the units continue to fully and promptly implement the compensation, support and resettlement work for the Cho Moi - Bac Kan expressway in Cho Moi district. The district was requested to re-count some inaccurate data and information. At the same time, the People's Committees at all levels were requested to closely monitor the statistical work to ensure compliance with requirements and clearly explain, and have a record of agreement with the people before moving on to the next step.

Regarding projects outside the boundary, such as repossessing houses without repossessing auxiliary works, repossessing fields without repossessing water ditches that can no longer be used... will the district consider providing any other support to people for projects outside the boundary according to regulations?

Regarding the recovery of all production land, the district has fully implemented policies to support job conversion. However, it is recommended that localities consider having plans to stabilize people's lives, especially those over 45 years old, because it is difficult for this group to change to another career...

The monitoring is organized to grasp the situation of people's access to regulations and policies on compensation, support and resettlement of the Cho Moi - Bac Kan expressway, thereby proposing and recommending to competent authorities to handle related problems and shortcomings in order to protect the legitimate rights and interests of the people./.
