The owner of the Tan Lap Islet residential area project in Nha Trang City still ignores organizing a dialogue with 233 people who were "taken money" to buy "paper houses" in the TM1 area and has just added another case of demanding to cancel the land sale contract that has collected money from people for 6-7 years.

At the Tan Lap Islet residential area project (Nha Trang City), a new case of anger has just arisen among many people who bought houses and land in a component project of 185 townhouses and villas, when the project owner arbitrarily demanded to collect more money for house construction, threatening to cancel the house and land sale contract for which they had collected land money 6-7 years ago.

At the end of December 2024, Song Da Nha Trang Joint Stock Company announced that customers must come to sign for the house and pay (70%) the construction cost of the raw house at the above-mentioned component project of the Tan Lap Islet residential area project with a price 3 times higher than the price of the signed sales contract.
People are forced to respond within 7 days from the date of that notice, otherwise the company will "take measures according to legal regulations".
Meanwhile, according to the signed house and land sale contract, a townhouse (5 floors, 105.44m2 of residential land) has a total value of more than 4,134 billion VND.
In which, the construction value (rough construction) of the mentioned adjacent house was signed with a total value of only nearly 1.5 billion VND, and the land use fee was 2.636 billion VND (price 25 million VND/ m2 ).
However, according to the recent announcement, Song Da Nha Trang Joint Stock Company has arbitrarily demanded that the people pay an additional 3.5 - 4.5 billion VND for each townhouse or villa (the cost of building the raw house is up to 9.3 million VND/m2 for a townhouse and 10.7 million VND/ m2 for a villa).
According to the petition of the group of home buyers, the total amount of money that the owner of the Tan Lap Islet residential area project demands to be collected from the residents in the entire area of townhouses and villas (including 136 townhouses and 49 villas) will be nearly 700 billion VND, which is a violation of the signed contract.
Song Da Nha Trang Joint Stock Company also continued to send "notice of termination of land use rights transfer contract" to a series of buyers of adjacent houses and villas mentioned above.
Meanwhile, according to the contract and payment confirmation of the company itself, people who bought land in the townhouse and villa area of the Tan Lap Islet residential area project, Nha Trang City, paid 95 - 100% of the land use fee to the project owner 6 - 7 years ago.
According to the collective petition and the petition of many individuals who bought the above houses and land, the owner of the residential area project of Con Tan Lap, Nha Trang City, arbitrarily demanding to collect more money for house construction, threatening to cancel the land sale contract for which they have collected land money from the people, is a disregard for the law, showing signs of "extortion of property". Therefore, the people protested and complained about those actions of Song Da Nha Trang Joint Stock Company.
Continuously ignoring instructions to dialogue with project home buyers
Also related to the Tan Lap Islet residential area project, on the afternoon of February 11, the leader of the Office of the Khanh Hoa Provincial People's Committee said that the Provincial Inspectorate had just reported that "up to now, Song Da Nha Trang Joint Stock Company and HP Hospitality Nha Trang Company Limited have not yet developed a handling plan or organized a dialogue conference with people related to the TM1 project of the Tan Lap Islet residential area project, Nha Trang City according to the direction of the Provincial People's Committee in the announcement dated December 25, 2024".
Nearly 2 months ago, the People's Committee of Khanh Hoa province held a meeting with units and investor enterprises at the Tan Lap Islet residential area project, Nha Trang city to consider removing difficulties for the project.
After that, Khanh Hoa Provincial People's Committee announced the conclusion, requesting Song Da Nha Trang Joint Stock Company and HP Hospitality Nha Trang Company Limited to agree on a plan to handle and resolve the petitions for 233 cases of customers who signed capital contribution contracts and paid money to buy "paper houses" with 310 Butterfly Tower apartments in the TM1 component project.
From 2015 to 2016, Song Da Nha Trang Joint Stock Company collected a total of about 200 billion VND from the sale of the above "paper houses" from the people and committed to handing over the apartments in the first quarter of 2017, but until now, the TM1 project is still vacant land.
The province has asked the above two enterprises to develop a plan to organize a dialogue conference with relevant people and send the results to the Provincial Inspectorate before December 30, 2024, but the enterprises have not implemented it.
On January 16, 2025, the Provincial People's Committee continued to issue a document requesting the implementation of that conclusion and sending a report of the results before January 24, 2025, but the enterprises still did not implement it, as reported by the Khanh Hoa Provincial Inspectorate above.
Therefore, up to now, the Provincial Inspectorate still has no basis to advise the Provincial People's Committee to participate in a dialogue conference with people complaining about the Tan Lap Islet residential area project.
