Approval of investment policy for Dong Anh industrial park with scale of nearly 300 hectares

Deputy Prime Minister Le Minh Khai has just signed Decision No. 221/QD-TTg dated March 5, 2024 approving the investment policy for construction and business of infrastructure of Dong Anh Industrial Park, Hanoi city.

The project's operating period is 50 years.

Vietnam Construction and Import-Export Joint Stock Corporation (Vinaconex) is the investor of the Project.

The project is implemented in the communes of Nguyen Khe, Xuan Non, Thuy Lam, Lien Ha and Dong Anh town, Dong Anh district, Hanoi city with a total investment capital of 6,338,478 billion VND, of which the investor's contributed capital is 1,267,696 billion VND.

The land use scale of the project is 299.45 hectares, including 2 phases: phase 1 is 179.1 hectares and phase 2 is 120.35 hectares; in which, the land area of ​​existing investors and enterprises that have leased land from the State in accordance with the provisions of law, in accordance with the N6 urban zoning plan and the Dong Anh industrial park construction zoning plan is not included in the area allowed to sublease land of investors.

The project's operating period is 50 years from the date the project is approved for investment policy at the same time as the investor's approval.

The Deputy Prime Minister requested the Ministry of Planning and Investment to take responsibility for the assigned contents of project investment policy appraisal and to perform state management of industrial parks in accordance with the provisions of the Investment Law and relevant laws.

Relevant ministries and branches are responsible for the content of project investment policy appraisal within their functions and tasks according to the provisions of the Investment Law and relevant laws.

Check, monitor and ensure project implementation is in accordance with planning location.

The Hanoi City People's Committee ensures the accuracy of information, reported data, and appraisal contents according to the provisions of law; the project's conformity with the planning approved by competent authorities and is responsible for the contents previously approved, appraised, approved or resolved; and accepts opinions from ministries and branches.

Inspect, supervise and ensure that the project is implemented in accordance with the approved planning location for the development of Dong Anh Industrial Park. The remaining planning area for the development of Dong Anh Industrial Park approved by the Prime Minister must not be transferred to other purposes without approval from competent authorities in accordance with the provisions of law on the management of industrial parks and economic zones and other relevant provisions of law.

Organize the establishment and approval of the zoning plan for the construction of Dong Anh industrial park in accordance with the provisions of the law on construction and the law on industrial parks and economic zones; consider allocating industrial land funds in Dong Anh industrial park for small and medium enterprises, priority enterprises, and support for production and business premises for land lease.

Check and determine whether the investor meets the conditions for the State to lease land and allow the change of land use purpose to implement the project at the time of leasing and allowing the change of land use purpose.

Organize the development and implementation of plans for land recovery, compensation, site clearance, change of land use purpose, land lease in accordance with the order, procedures, and regulations of land law, regulations on management and use of rice-growing land and related documents; in accordance with relevant land use planning and plans...

The Hanoi People's Committee directs the Hanoi Industrial and Export Processing Zones Management Board and relevant agencies to monitor and evaluate the project implementation, including contributing sufficient capital and on time as committed by the investor to implement the project in accordance with the provisions of the law on land and other relevant laws; guiding investors to comply with the conditions for real estate business in accordance with the provisions of the law on real estate business.

Guide, inspect and supervise investors in implementing the approved zoning plan for the construction of Dong Anh industrial park, noting that investment in construction and investment attraction in Dong Anh industrial park must be consistent with the new development orientation of the Capital and the development orientation of industries in the Red River Delta region as prescribed in Point b, Clause 1, Article 3 of Resolution No. 81/2023/QH15 dated January 9, 2023 of the National Assembly on the national master plan for the period 2021 - 2030, with a vision to 2050; comply with the regulations and standards for construction of drainage and wastewater treatment systems as prescribed by law...

Ensure adequate equity contribution as committed

Vietnam Construction and Import-Export Joint Stock Corporation (investor) is responsible before the law for the legality, accuracy and honesty of the project dossier content and documents sent to competent state agencies.

Ensure to contribute sufficient equity capital as committed to implement the project on schedule and in compliance with the provisions of the law on land; fully meet the conditions prescribed in Clause 2, Article 4 of Decree No. 02/2022/ND-CP dated January 6, 2022 of the Government detailing the implementation of a number of articles of the Law on Real Estate Business when conducting business activities in industrial park infrastructure.

At the same time, the project can only be implemented after meeting all conditions prescribed by law, including being permitted by competent authorities to change the purpose of using rice-growing land and being responsible for paying a sum of money to protect and develop rice-growing land according to the provisions of Clause 3, Article 134 of the Land Law and Article 45 of Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government detailing the implementation of a number of articles of the Land Law...
