The Government Inspectorate (GIA) has just issued a notice concluding the inspection of the responsibility for performing public duties of cadres, civil servants, and public employees in handling administrative procedures (AP) and providing public services to people and businesses at the Ministry of Education and Training (MOET).

The inspection conclusion announcement shows that in addition to the results achieved, the Ministry of Education and Training still has many limitations, shortcomings, and violations. The inspection results of 10 administrative procedures and 18 administrative procedure settlement files at the Department of Organization and Personnel, Department of Quality Management, Department of International Cooperation discovered a number of limitations, shortcomings, and violations.
Specifically, the Ministry of Education and Training reported that the results of handling administrative procedures did not reflect the actual situation and were inaccurate. The Ministry periodically reported to the Government that the results of handling administrative procedures in 2021 and 2022 were 100% on time, while the inspection of 10 administrative procedures had 419 overdue records, accounting for 2.27% of the resolved records, of which 3 administrative procedures had an overdue record rate of over 50%. The processing of records was delayed and exceeded the deadline for handling administrative procedures according to regulations.
According to the Government Inspectorate, the agency handling administrative procedures did not seriously apologize to people and businesses when the processing time was overdue according to regulations. The request for people and businesses to supplement and complete documents outside the list of prescribed documents caused frustration and inconvenience for people and businesses, who had to travel, explain, and supplement many times, potentially posing a risk of harassment...
Regarding the management and settlement of administrative procedures "Approval of joint organization of foreign language proficiency exams" before the effective date of Circular No. 11/2022/TT-BGDDT (August 2018 to September 2022), the Ministry of Education and Training has loosened management, allowing violations in joint organization of foreign language proficiency exams to continue for a long time, but has not taken timely measures to prevent, rectify, and handle them, causing public outrage.
Regarding 18 administrative procedure settlement records inspected, the Government Inspectorate concluded that the reception of administrative procedure settlement records still had a situation where units under the Ministry received the records but did not transfer them to the Ministry's department one for monitoring and processing according to regulations. There was a situation where the records were refused to be settled but not returned; the refusal to settle documents did not follow the prescribed form.
The time limit for handling administrative procedures of the inspected files was mostly overdue (13/18 files), of which 1 file was overdue for 7 months, 8 files were overdue for more than 30 days. However, according to the Government Inspectorate, the agency handling administrative procedures did not apologize to the people and businesses as prescribed.
Some agencies under the Ministry of Education and Training also requested businesses to supplement and explain many times with different requests that were against regulations; requested to supplement documents and papers outside the list of prescribed documents, causing inconvenience to people and businesses having to go back and forth many times...
The Department of International Cooperation issued Graduation Certificates for 3 administrative procedure files that were not under its authority; the Department of Quality Management issued Diploma Recognition Certificates not following the prescribed procedures for 2 administrative procedure files "Diploma Recognition".
The Government Inspectorate also pointed out that the leaders of the Ministry of Education and Training and heads of some departments and divisions under the Ministry have not been closely involved in leading, directing, urging, checking and inspecting the state management work and handling administrative procedures of cadres, civil servants and public employees. Some civil servants and public employees have not fully and seriously performed their responsibilities of advising on handling administrative procedures.
Some civil servants and public employees directly handling administrative procedures are not proactive and urgent in performing their duties, leading to delays, additional requests and lawsuits outside of regulations, and not creating favorable conditions for people and businesses...
Based on the inspection results, the Government Inspectorate recommends that the Prime Minister direct the Ministry of Education and Training, within its authority, to overcome some shortcomings in handling administrative procedures and providing public services. In particular, it is necessary to review the approval of joint organization of foreign language proficiency certification exams.
In addition, the organization reviews the responsibilities of leaders and review the Ministry's leaders related to shortcomings in State management and handling administrative procedures, providing public services to people and businesses.
