The Ministry of Public Security has just announced a draft Decree regulating the signals of priority vehicles, drafted by the ministry, to solicit comments from organizations and individuals.
According to the Ministry of Public Security, the new decree is built on the basis of inheriting the provisions of Decree 109/2009 currently in effect, regulating the same content.
Different from the current situation, the Ministry of Public Security proposes detailed regulations on the subjects that are allowed to install and use signal devices of priority vehicles when participating in traffic, for tighter control.
7 subjects that are allowed to install and use vehicle signaling devices have priority rights, including:
- Fire trucks on duty;
- Military vehicles on emergency missions, including: military vehicles performing firefighting, rescue, combat command, urgent information missions, marching group command, vehicles performing military control missions, checking military vehicles, protecting groups; vehicles performing arrest, search or investigation activities, escorting criminals, prisoners, participating in preventing and combating terrorism.
- Police vehicles on emergency missions, including: vehicles on rescue missions; vehicles on arrest, search or conduct investigation activities, escort criminals, prisoners, fight against protests, riots, disperse crowds that disturb public order; vehicles on traffic patrol and control missions; vehicles on guard missions; anti-terrorism command vehicles; information vehicles on urgent missions; vehicles commanding military convoys.
- Traffic police car leading the way;
- An ambulance on emergency duty is a vehicle transporting an emergency patient or picking up an emergency patient;
- Dike protection vehicles on duty, vehicles on duty to respond to incidents, natural disasters, and epidemics.
- Vehicles performing tasks in emergency situations as prescribed by law, including: vehicles serving steering committees assisting the Prime Minister in implementing resolutions of the National Assembly Standing Committee or orders of the President declaring a state of emergency; vehicles serving rescue forces, medical forces, environmental protection forces, agricultural forces and other forces mobilized by the steering committee to implement special measures in emergency situations.
Prohibited Behaviors
According to the draft, to avoid the situation of vehicles installing priority devices spreading, causing disorder and traffic safety, the Ministry of Public Security proposes regulations on prohibited acts.
One of these is a priority vehicle but the installation and use of horns, flags, and priority signal lights are of the wrong type, in the wrong location, and not fully installed according to regulations.
Priority vehicles use priority signals when not on duty or take advantage of priority signals to commit illegal acts.
Vehicles on duty in an emergency situation as prescribed by law use priority signals when a state of emergency has not been declared and apply special measures in an emergency situation.
Another prohibited behavior is that the driver of a priority vehicle uses a priority signal that causes traffic insecurity for other traffic participants, affects security and order, and does not comply with the commands of a traffic controller.
Or road motor vehicles that are not priority subjects but install, use horns, flags, priority signal lights or install similar devices that cause confusion to other traffic participants.
The draft prepared by the Ministry of Public Security also stipulates that the horns, flags, and lights of priority vehicles must be installed in the correct positions. The horn and light signals of priority vehicles must have sufficient sound and light to be recognized by people and vehicles participating in traffic.
For cars, the priority signal light is mounted on the roof of the car, above the driver; the priority signal horn is mounted inside the car or on the roof; the signal flag is placed at the front of the car on the left side of the driver.
For motorcycles, the priority signal light is installed on the right fork, front or rear; the priority signal horn is installed at the front of the vehicle; the signal flag is placed at the front of the vehicle.
