According to the units providing non-stop electronic toll collection services, during the toll collection process, the units encountered a number of situations arising with rescued vehicles.
Specifically, a representative of VETC Automatic Toll Collection Company Limited said that according to Decision 1697/2024 of the Ministry of Transport, there is no guidance on collecting road use fees for salvaged vehicles. This means that salvaged vehicles are subject to toll collection.
According to the law, towed vehicles are not subject to road tolls.
However, when collecting fees for towed vehicles, a situation arises where the tow truck tows and carries the towed vehicle into the non-stop toll lane, so it is not possible to ask the tow truck driver to stop and park to collect fees for the towed vehicle.
In addition, there are many cases where the rescued vehicles do not have license plates or have not declared ETC when passing through the station, making it impossible to determine the type of vehicle as a basis for collecting fees.
However, according to Decree 130/2024, there is no fee for using highway services for towed vehicles. This means that towed vehicles are exempt from the fee.
Accordingly, towed vehicles are not charged for highway tolls but are charged for highway tolls, leading to difficulties in explaining to vehicle owners who are used to free tolls on highways.
Having the same problem as above, VDTC Digital Traffic Joint Stock Company believes that there should be specific instructions for cases where vehicles are rescued when traveling through toll stations applied according to Decision 1697 to be consistent with Decree 130/2024.
Explaining this issue, the Vietnam Road Administration said that Article 54 of the Law on Road Traffic Order and Safety stipulates: "A road traffic rescue vehicle is a specialized car equipped with tools and equipment used to rescue, support the movement or transport damaged or broken road vehicles."
Thus, vehicles that need to be rescued are damaged vehicles or vehicles that have had an accident and cannot move on their own; they must be equipped with tools and equipment for rescue, support movement or transportation.
Meanwhile, Circular No. 32/2024 of the Ministry of Transport stipulates: "The subjects paying for road use services are road vehicles circulating through toll stations of road construction investment projects for business managed by the central government".
From the above regulations, the Department of Roads affirms: Rescued vehicles are not subject to payment for road use services according to regulations.
