As VietNamNet reported, the Supreme People's Procuracy has just completed the indictment to prosecute 24 defendants in the smuggling ring of 6,150kg of 9999 gold for the crime of Smuggling. Among the defendants, Dang Nam Trung regularly traveled between Hanoi and Ho Chi Minh City to deliver money and receive gold to bring to Hanoi as assigned by defendant Dang Thi Thanh Hang.

When checking in for the flight, Trung went through the VIP security check at Tan Son Nhat airport and became acquainted with many airport security staff.

When Trung brought gold to Hanoi, he always asked to go through the boarding procedures first. In cases where Trung did not bring the gold himself but gave it to a person named Trinh Viet Chau or sent it to a Vietnam Airlines flight attendant, Trung always asked the security staff on duty to let these individuals carry the gold through the security gate.

The accusation is that the defendant Dang Nam Trung and a person named Trinh Viet Chau, along with a number of Vietnam Airlines flight attendants, brought solid gold (gold bars) through security to board a plane from Ho Chi Minh City to Hanoi.

Checking the security screening results at Tan Son Nhat airport, it was only determined that flight VN204 on September 28, 2022, Dang Nam Trung flew from Ho Chi Minh City to Hanoi carrying solid gold.

In connection with this smuggling of gold, there were the commander of the Domestic Security Screening Team, the Chief of the Domestic Security Screening Team, and the passenger checkers, identity checkers, staff monitoring the screen of the carry-on baggage scanner, and visual checkers at the carry-on baggage scanner.

During the screening process, airport staff observed the screen and noticed that there were no dangerous items inside, only some metal objects in block shapes, which were not prohibited from being carried on the plane, so they did not perform a visual check of the luggage to allow passenger Dang Nam Trung to complete the security check at 4:15 a.m., nor did they report to the officer on duty when there were many metal objects in Trung's 3 packages.

According to the prosecution agency, this is not a dangerous item prohibited from being carried on an airplane, so there is no basis to prosecute the individuals involved.

Transporting smuggled gold through border gates

The investigation results determined that between 4:30 p.m. and 4:55 p.m. on September 20, 23, 24 and 27, 2022, a male subject rode a three-wheeled vehicle from Cambodia through barrier No. 1 of Chang Riec border gate into Vietnam. The vehicle did not have a license plate (homemade vehicle), and the three-wheeled vehicle did not carry any goods, and he hid smuggled gold to transport into Vietnam (to Nguyen Thi Ngoc Giau's house).

The subjects took advantage of the State's policy on managing people and vehicles that are border residents who regularly cross the border gate to smuggle gold.

The results of working with the Xa Mat Border Gate Customs Branch determined that the above time period was within the duty schedule of two customs officers, Nguyen Thanh Lam and Nguyen Gia Hung. However, the vehicle driven by the accused Tran Thanh Thang was not subject to customs inspection.

The statements of the defendants, individuals involved in the case and the collected documents do not prove that the customs officers were involved in gold smuggling, so there is not enough basis to consider the responsibility of the two customs officers Nguyen Thanh Lam and Nguyen Gia Hung.

However, the Supreme People's Procuracy said that it is necessary to recommend that the Tay Ninh Provincial Customs Department review the regulations on controlling people, vehicles and goods crossing the border, to avoid subjects taking advantage of the situation to commit crimes and to consider the responsibility of related officials.

According to the indictment, during working hours, the Chang Riec Border Guard Station arranged officers to coordinate with the Customs and Quarantine forces to control the border gate area. Outside of working hours (from 5:00 p.m. to 7:00 a.m. the following day), the border guards were responsible for guarding to ensure national security, prevent drug crimes, smuggling, and trade fraud.

During this time, people, vehicles and goods are not allowed to pass through the border gate, except in cases of force majeure as prescribed by law.

Investigation results determined that from August 3, 2022 to September 28, 2022, between 4:30-5:00 and 17-18:00, defendant Tran Thanh Thang regularly delivered motorbikes with ice-carrying containers to a Cambodian subject at barrier area No. 1 of Chang Riec border gate, under the direct control of Border Guard Station officers Mai Xuan Phuong, Huynh Minh Thien, Trinh Son Tung, Tran Van Hoe, Le Thanh Tu, Trinh Van Dum, Nguyen Bao Toan, Nguyen Trong Huu and Le Van Luc.

The behavior of the above officials shows signs of the crime of Lack of responsibility causing serious consequences, as prescribed in Article 360 ​​of the Penal Code.

Considering that this violation falls under the investigation authority of the Investigation Agency in the People's Army, the Ministry of Public Security's Investigation Police has transferred all related documents to the Ministry of National Defense's Criminal Investigation Agency for investigation and handling according to its authority.
