Participating in the discussion, delegate Duong Van Phuoc - Deputy Head of the Quang Nam National Assembly Delegation welcomed the Law Drafting Committee for promptly synthesizing all the contents of the Quang Nam National Assembly Delegation and of individual delegates who spoke at the discussion session in groups on October 24. The delegate also contributed some additional contents to complete the draft law.

Regarding the principles of operation and dispatching of the national power system, Clause 6, Article 61 stipulates: "In case of emergency or abnormal situations that seriously threaten the safe and reliable operation of the national power system, the Minister of Industry and Trade shall decide on the operation and mobilization of power plants to ensure electricity supply".

However, according to delegate Duong Van Phuoc, the issue of deciding on the operation and mobilization of power plants to ensure electricity supply security must be reported by the Minister of Industry and Trade to the Prime Minister for decision. The delegate believes that the Prime Minister has full authority according to the Law on Government Organization and demonstrates the state monopoly on state management responsibilities when mobilizing capacity or auxiliary activities to ensure operational safety and energy security.

At the same time, it is proposed to add the Capital Management Committee to the provisions of this article, because the Ministry of Industry and Trade is not the representative agency of the owner but the Capital Management Committee related to the sole buyer of electricity, which is Vietnam Electricity Group (EVN).

During the process of implementing investment in the construction of power projects, investors have to pay huge costs. In practice, for many reasons, including changes in direction and policies of competent authorities, the project has to stop implementation.

However, current laws and drafts do not have specific regulations on the mechanism for handling costs that investors have spent to implement the project, such as: survey costs, costs of preparing feasibility study reports, costs of preparing bidding documents... Therefore, delegates proposed that the draft law consider adding a mechanism for handling construction investment costs and other costs spent when stopping the implementation of power source and grid construction investment projects.

Regarding the issues that delegates discussed in the afternoon group on October 24, although the Drafting Committee had compiled and explained them, they had not been accepted, adjusted, or supplemented in this draft law. Therefore, delegates requested that the Drafting Committee consider, accept, and complete the draft law, meeting practical requirements and ensuring the feasibility of the draft law after it is promulgated.
