Prime Minister: Institutions must liberate production capacity and mobilize all resources for development.

(Chinhphu.vn) - On March 19, Prime Minister Pham Minh Chinh chaired the Government's special meeting on law making in March 2025 to discuss and give opinions on 4 draft laws and proposals for law making.

Attending the meeting were Deputy Prime Ministers; Deputy Secretaries of the Government Party Committee; ministers, heads of ministerial-level agencies, government agencies; leaders of ministries, branches and central agencies.

At the meeting, the Government reviewed and discussed: the draft Law on Atomic Energy (amended); the draft Law on Science, Technology and Innovation; the draft Law on Economical and Efficient Use of Energy; and the proposal to develop the Law on Enterprises (amended).

Discussing and giving opinions on each content with members of the Government, Prime Minister Pham Minh Chinh highly appreciated the presiding agencies for actively preparing, seriously receiving, explaining, and expressing the enthusiastic, responsible, practical, and quality opinions of the delegates; requested the ministers to direct the drafting agencies to promptly complete and proactively coordinate with the National Assembly agencies in submitting, receiving, completing, and submitting the draft laws.

The Prime Minister also assigned the Deputy Prime Ministers in charge of the field to directly direct the completion of draft laws and propose law making.

Regarding the draft Law on Atomic Energy (amended) chaired by the Ministry of Science and Technology, the Prime Minister stated that it is necessary to continue reviewing the mechanisms and policies in Resolution 189/2025/QH15 of the National Assembly on a number of special mechanisms and policies for investment in the construction of the Ninh Thuan Nuclear Power Project for legalization. Along with that, refer to and inherit the achievements of mankind; Vietnamize international regulations and those of other countries that can be applied appropriately to Vietnam's conditions.

Regarding the draft Law on Science, Technology and Innovation chaired by the Ministry of Science and Technology, the Prime Minister requested to continue reviewing and legalizing the contents of Resolution 57 of the Politburo, policies in Resolution 193/2025/QH15 of the National Assembly to pilot a number of special mechanisms and policies to create breakthroughs in the development of science, technology, innovation, national digital transformation, and other resolutions related to science and technology.

Emphasizing that scientific research and innovation have no limits, the Prime Minister said that it is necessary to open up creative space, encourage innovation, accept risks and delays; apply a controlled testing mechanism; encourage innovation in both the public and private sectors so that everyone can innovate, every household can innovate; focus on protecting and enforcing intellectual property rights; promote decentralization and delegation of authority, especially for institutes, schools, and research entities...

Regarding the proposal to develop the Law on Enterprises (amended) chaired by the Ministry of Finance, the Prime Minister emphasized the spirit of untying and untying enterprises, creating motivation for enterprises to develop as much and as strongly as possible, including private enterprises, in the spirit of the article "Private economic development - Leverage for a prosperous Vietnam" by General Secretary To Lam.

According to the Prime Minister, it is necessary to complete a legal framework that is safe, transparent, manageable but also developable, with the orientation being to control output and strengthen post-audit. Administrative procedures must be simple so that businesses can register, enter the market quickly and withdraw quickly when needed. There must be mechanisms and policies to develop businesses quickly and sustainably, both increasing the quantity and improving the quality of businesses, creating conditions for businesses to grow, participate in global supply chains, pioneer in science and technology, innovate, contribute to the country, and ensure social security.

Regarding the draft Law on Economical and Efficient Use of Energy developed by the Ministry of Industry and Trade, the Prime Minister proposed to review it to have a broader scope and subjects of regulation, including all five stages: power source, power load, use, distribution and electricity price; including production, business and consumption entities.

In his concluding remarks at the meeting, the head of the Government said that investing in institutions is investing in development; institutions are the breakthrough of breakthroughs, but are still the bottleneck of bottlenecks, so investing in institutions is the most effective investment in the current context.

The Prime Minister emphasized the need to continue to innovate thinking and approaches with a practical spirit, to build and perfect laws that are suitable for the rapidly changing reality; to ensure regulations are highly feasible, meeting urgent and immediate requirements, but also relatively sustainable and stable with the mindset of "looking far and wide, thinking deeply and doing big things", so that people and businesses can work with peace of mind, liberating production capacity, mobilizing all resources of the State, among the people, and in society for development.

The Prime Minister requested ministers, heads of ministerial-level agencies and government agencies to directly lead, direct, spend time, effort and intelligence on this work; prioritize resources, facilities, increase technology application, digital transformation, AI application, pay attention to ensuring appropriate policies for officials working on institutional and legal development; and participate in giving opinions and developing legal documents chaired by other ministries, branches and agencies.

The Ministry of Justice shall preside over and work with relevant agencies to continue reviewing and, in particular, encourage localities to review, synthesize, and propose solutions to difficulties and problems in current legal regulations. In 2025, focus on amending, supplementing, and perfecting regulations to maximize resource mobilization for growth.

The Prime Minister stated that the process of building and perfecting laws must ensure full institutionalization of the Party and State's guidelines, policies, and resolutions and conclusions of the Central Committee, Politburo, and Secretariat.

To improve quality, save time, and ensure progress, the process of building and perfecting laws must ensure clarity: omitted contents; inherited contents; revised and perfected contents; newly added contents; has the reduction of administrative procedures reached the target of at least 30%; decentralization and delegation of powers, obstacles that need to be resolved; how to handle issues with different opinions, and who has the authority.

Affirming the need to resolutely abandon the mindset of banning what cannot be managed, the Prime Minister also said that the law should be regulated in a framework-oriented manner, with principles, standards, and criteria, and should only regulate issues under the authority of the National Assembly; as for issues under the authority of the Government, it is proposed that the Government provide detailed regulations to ensure the stability of the law and ensure the Government's initiative in management and administration.

Promote decentralization and maximum delegation of power where possible, along with resource allocation, improve implementation capacity in the spirit of "local decision, local action, local responsibility"; manage according to output, promote proactiveness, flexibility, and creativity at all levels, reduce the concentration of work on higher levels and central agencies.

Along with that, the organization implements and assigns work in the spirit of 5 clear: "clear people, clear work, clear time, clear responsibility, clear product".

Regarding a number of specific and key tasks in the coming time, the Prime Minister requested ministries, branches, agencies and localities to continue to well organize the implementation of laws and resolutions passed by the National Assembly at the 9th extraordinary session of the 15th National Assembly.

Regarding the Law on Promulgation of Legal Documents, the Prime Minister assigned the Ministry of Justice to promptly submit to the Government a Decree detailing a number of articles and measures to organize and guide the implementation of this Law.

The Ministry of Justice and the Government Office monitor and urge relevant ministries, agencies and localities to develop and implement laws and resolutions passed by the National Assembly; promptly report to the Prime Minister and Deputy Prime Minister in charge on problems and difficulties in the implementation process.

The Prime Minister also directed agencies to urgently complete and submit to the National Assembly laws and resolutions at upcoming sessions to ensure progress and quality. At the 9th session, the 15th National Assembly is expected to submit to the National Assembly about 30 draft laws and resolutions.
