The Prime Minister has just issued Official Dispatch No. 125/CD-TTg on promoting thrift practice and combating waste.
In 2024, despite many difficulties and challenges, the Government, ministries, branches and localities will resolutely and effectively deploy and implement the provisions of the Law on Practicing Thrift and Combating Wastefulness (THTK, CLP), the Resolutions of the National Assembly, the Government and the tasks and solutions set out in the Government's Overall Program on THTK, CLP; THTK, CLP work has had many changes and achieved important and positive results in all fields, contributing to the successful implementation of socio-economic development goals and targets, finance, budget, mobilization, management and effective use of human resources, material resources, financial resources, ensuring national defense, security, foreign affairs, social security and social welfare of the country; awareness and responsibility for THTK, CLP of ministries, branches and localities have been raised.
However, the implementation of policies and laws on THTK and CLP still exists and has limitations: the situation of outstanding debts and slow issuance of detailed regulations has not been completely resolved; disbursement of public investment capital, progress of equitization, divestment and approval of the State-owned enterprise restructuring project for the period 2021 - 2025 is still slow; violations in the management and use of land, mineral and environmental resources still occur; compliance with the law is not strict; in some cases, loss and waste are very large and serious... The above-mentioned shortcomings and limitations are due to many causes.
Besides the reason that some legal regulations, norms, standards, norms, and unit prices are still inadequate and have not kept up with the requirements of economic and social development, the main reason is the organization of implementation of policies and laws on THTK and CLP.
To continue to enhance the effectiveness and efficiency of the implementation of policies and laws on THTK and CLP, the Prime Minister requests Ministers, Heads of ministerial-level agencies, Government agencies; Chairmen of People's Committees of provinces and centrally run cities to focus on implementing the following tasks and solutions:
Organize to thoroughly grasp and seriously and effectively implement Directive No. 27-CT/TW dated December 25, 2023 of the Politburo on strengthening the Party's leadership over the work. practice thrift, combat waste; direction of General Secretary To Lam on combating waste; Resolution No. 98/NQ-CP dated June 26, 2024 of the Government promulgating the Government's Action Program to implement Directive No. 27-CT/TW dated December 25, 2023 of the Politburo. Continue to strictly implement Resolution No. 53/NQ-CP dated April 14, 2023 of the Government on implementing Resolution No. 74/2022/QH15 dated November 15, 2022 of the National Assembly on promoting the implementation of policies and laws on thrift, waste management and the Government's Overall Program on thrift, waste management in 2024.
Strengthen leadership and direction on THTK and CLP; ministries, branches and localities within their management scope are responsible for directing the unified implementation of THTK and CLP goals and targets in 2024 according to the Party's orientation and policies and legal regulations on THTK and CLP.
Complete legal regulations related to THTK and CLP work, focusing on reviewing and proposing amendments to the Law on THTK and CLP (Law No. 44/2013/QH13 dated November 26, 2013); review and supplement regulations on management mechanisms and economic and technical norms that are no longer suitable to the country's development practices. Continue to review and propose amendments to laws and legal documents related to THTK and CLP work to ensure consistency and unification of the legal system, overcome overlaps and contradictions, and improve the effectiveness of management and use of State resources.
Promote information, propaganda and dissemination of laws on THTK, CLP and the Party and State's policies related to THTK, CLP to raise awareness and unify responsibility for the goals, requirements and significance of THTK, CLP for agencies, enterprises, organizations, individuals and the whole society; build a culture of waste prevention and combat, making THTK, CLP voluntary and self-conscious. Timely commend and reward typical examples in THTK, CLP; implement measures to protect people who provide information on waste detection.
Strengthen the organization of THTK and CLP in all fields, focusing on the following areas:
Regarding state budget management: Focus on effectively implementing the policy mechanisms in the Law amending and supplementing a number of articles of the Securities Law; the Accounting Law; the Independent Audit Law; the State Budget Law; the Law on Management and Use of Public Assets; the Tax Management Law; the Law on National Reserves; strengthen the practice of thrift, combat waste in the use of the state budget; thoroughly cut down on regular expenditures and non-urgent expenditures to reserve development investment expenditures, especially important and essential socio-economic infrastructure projects. Continue to innovate the method of managing regular expenditures, increase bidding, ordering, and budget allocation, encourage decentralization, delegation of authority, and grant autonomy to state budget-using units. Strengthen inspection, examination, supervision, and transparency in the use of regular expenditures of the state budget. Timely remove obstacles in the implementation of financial mechanisms of public service units. Innovate the organizational and management system and improve operational efficiency to streamline focal points, overcome overlaps, dispersion and duplication of functions and tasks of public service units.
Regarding the management and use of public investment capital: Urgently implement Official Dispatch No. 112/CD-TTg dated November 6, 2024 of the Prime Minister on focusing on resolving backlog projects, stopping construction, urgently completing and putting them into use to prevent waste and loss.
Strengthen the implementation of the Law on Public Investment, speed up investment preparation, and resolutely cut unnecessary procedures. Review and perfect mechanisms, policies, and regulations of laws on public investment and related laws to promptly remove difficulties and obstacles and improve the efficiency of public investment. Focus on directing, urging, and further enhancing the responsibility of leaders in disbursing public investment capital. Strengthen field inspection and supervision, urge contractors and consultants to speed up progress. Timely handle difficulties and obstacles, and thoroughly resolve long-standing problems to speed up the progress of important and key national infrastructure projects and works, and prevent loss and waste. Regularly review and promptly adjust the 2024 public investment capital plan from projects that have not been disbursed or are slow to disburse to projects that are capable of disbursing and need additional capital plans. Promote the application of information technology in management, monitoring and supervision of public investment project progress.
Regarding the management and use of public assets: Continue to fully and seriously implement Directive No. 32/CT-TTg dated December 10, 2019 of the Prime Minister on promoting the implementation of the Law on Management and Use of Public Assets and documents detailing the implementation of the Law. In particular, focus on implementing regulations on standards, norms, and regimes for the management and use of public assets; modernize the management of public assets, build a component database to connect to the National Database on Public Assets; strengthen inspection, examination, and supervision of the management and use of public assets at agencies, organizations, and units.
Ministries, branches and localities shall review all public assets and working offices that are not used, used ineffectively or used for the wrong purpose to decide on handling according to their authority or to report to competent authorities for decision on handling according to regulations, to avoid waste or loss of state assets; synthesize the results of the review and handling and send them to the Ministry of Finance before December 8, 2024 for synthesis and reporting to the Prime Minister before December 15, 2024.
Ministries, branches and localities shall direct and strictly organize the implementation of the General Inventory of public assets at agencies, organizations and units; infrastructure assets invested and managed by the State according to the Project approved by the Prime Minister in Decision No. 213/QD-TTg dated March 1, 2024, ensuring progress according to plan.
Regarding the management of resources and minerals, especially land: Strengthen the application of information technology in the establishment and supervision of the implementation of land use planning and land management plans; forecast, warn, investigate, evaluate, respond to climate change, manage resources and protect the environment to meet the requirements of land management and international integration. Publicize and make transparent land use planning and plans according to regulations. Strengthen inspection and examination work; review and correctly assess the current status of projects that do not put land into use, slow progress in land use nationwide, propose solutions and measures to remove difficulties and obstacles to free up land resources, speed up project implementation, put land into economical and effective use, and promote land resources.
Regarding the management of state capital and assets invested in enterprises: (1) Complete the restructuring and improve the operational efficiency of state-owned enterprises and enterprises with state capital; (2) Promote the restructuring of state-owned enterprises to improve operational efficiency, financial capacity, innovate governance, technology, restructure products, industries, and production and business sectors, and improve production processes to improve competitiveness. Carry out inspection, examination, auditing, and supervision according to regulations and plans on the implementation of policies and laws on the management and use of capital and assets of state-owned enterprises. The Ministry of Finance shall coordinate with the Steering Committee for Enterprise Innovation and Development to inspect the approval status of the State-owned Enterprise Restructuring Project according to Decision No. 360/QD-TTg dated March 17, 2022 of the Prime Minister, synthesize the report to the Prime Minister, propose solutions to handle the agencies representing the owners and state-owned enterprises that have not approved the Project according to the proposed Plan, and report to the Prime Minister in March 2025.
Regarding organization, labor management, working time:
Urgently summarize the 7-year implementation of Resolution No. 18-NQ/TW dated October 25, 2017 of the 6th Central Conference, 12th tenure and develop a plan to arrange and restructure the apparatus towards a multi-sectoral, multi-field ministry, reduce internal organization, ensure streamlining, efficiency, effectiveness and efficiency in accordance with the direction of the Politburo, the Government and the Prime Minister. Review and perfect the mechanism, policies and laws on the management of cadres, civil servants and public employees.
Increase publicity and transparency in public service activities, improve the capacity and qualifications of cadres, civil servants and public employees. Strictly manage working time, inspect and supervise quality, ensure productivity, work efficiency and public ethics of cadres, civil servants, public employees and workers at agencies and organizations in the State sector.
Implement administrative reform solutions synchronously. Strictly implement publicity and transparency in receiving and handling administrative procedures. Minimize administrative procedures and compliance costs, create the greatest convenience for people and businesses; switch from pre-inspection to post-inspection, eliminate the "ask-give" mechanism; decentralize and delegate authority to competent agencies and localities to resolve and take responsibility. Strengthen supervision, evaluation and accountability of state agencies, cadres, civil servants and public employees in serving the people.
Comprehensive digital transformation of administrative procedures, especially licensing activities, strongly shifting to automatic licensing based on technology applications and digital data.
Strengthen inspection, examination and strict handling of violations of regulations on THTK and CLP: Promote and improve the effectiveness of inspection and examination of the development and implementation of the THTK and CLP Program; inspect and examine the implementation of legal provisions in areas under the provisions of the Law on THTK, CLP and specialized laws, focusing on key areas such as land, public investment, construction, public finance, resources and minerals. Strictly implement legal provisions on handling violations against heads of agencies, units and individuals who cause waste.
The Prime Minister assigned the Ministry of Finance to preside over and coordinate with ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally run cities:
Complete legal regulations related to THTK and CLP work, propose amendments to the Law on THTK and CLP (Law No.: 44/2013/QH13 dated November 26, 2013).
Synthesize and report to the Prime Minister the results of reviewing all public assets and unused or ineffectively used offices and propose solutions according to regulations to prevent waste and loss of State assets.
Strengthen inspection and examination of law enforcement on practicing thrift and combating waste.
Ministries, ministerial-level agencies, Government agencies; People's Committees of provinces and centrally-run cities, based on their assigned functions and tasks, shall resolutely, synchronously and effectively implement the above-mentioned tasks and solutions; promptly report to the Prime Minister and Deputy Prime Minister in charge on issues arising beyond their authority.
The Prime Minister assigned Deputy Prime Minister Ho Duc Phoc to directly direct the implementation, urge and handle difficulties in the implementation of this Official Dispatch.
