Tightening tax management in the field of real estate business and transfer not only contributes to stabilizing and increasing revenue for the State budget, but also creates an effect on the awareness of tax law compliance of each citizen, creating fairness, publicity and transparency in fulfilling tax obligations.
Provincial Tax Department officials reviewed cases of real estate transfers in the same location with inappropriate land prices.
To avoid tax losses in real estate transfers, the Provincial Tax Department has requested tax branches to build a database on transfer prices and real estate auction prices in the area, regularly update it over time to serve as a reference basis, and fight against taxpayers with transfer contracts with unusually low transfer prices.
According to statistics from the Provincial Tax Department, in 2023, the number of price adjustment records recorded by tax branches was 9,177 records; the tax collection increased by more than 35 billion VND. Some units with high tax increases such as: Viet Tri City Tax Branch increased by 11 billion VND; Lam Thao - Phu Ninh Regional Tax Branch increased by 6.6 billion VND; Phu Tho Town Tax Branch increased by 6.9 billion VND; Thanh Ba - Ha Hoa Regional Tax Branch increased by 5.3 billion VND; Thanh Son - Tan Son Regional Tax Branch increased by 3.4 billion VND...
Entering 2024, the work of preventing revenue loss from real estate transfer activities continues to be promoted by tax branches. In the first 6 months of the year alone, income tax collection from real estate transfer, inheritance and real estate gifts is estimated at 72 billion VND, an increase of 12 billion VND over the same period.
In addition to the positive results achieved at the beginning of the year, the Tax sector still faces many difficulties such as the lack of a database on transaction prices in the real estate market, so it is very difficult for tax authorities to determine the real transfer price with taxpayers. The construction of State prices is not close to market prices, this is also a loophole for many individuals and organizations to "avoid" taxes when declaring transfer prices that are not true to actual prices. In particular, the sense of self-consciousness in fulfilling tax obligations of a part of the population is not high, awareness of the law is still low, and they are not aware of the consequences of declaring taxes at prices that are not true to actual transfer prices.
Viet Tri City is always among the localities with the highest real estate transfer tax revenue in the province.
Faced with that situation, Mr. Do Trong Bong - Deputy Director of the Provincial Tax Department said: To avoid tax losses in real estate transfers, the Provincial Tax Department has requested tax branches to build a database on transfer prices and real estate auction prices in the area, regularly updating over time to serve as a reference to fight against taxpayers with transfer contracts with unusually low transfer prices. At the same time, tax branches need to increase propaganda on mass media about the responsibilities of real estate sellers and buyers, tax evasion and sanctions according to the provisions of law as well as legal risks that buyers and sellers will encounter when declaring incorrect transaction prices on real estate sales contracts. Publicize at the one-stop department of agencies, disseminate on mass media, social networks... so that many people know and implement.
To continue to rectify and prevent negativity in real estate trading and transfer activities, recently, Minister of Finance Ho Duc Phoc directed the General Department of Taxation to urgently consult on solutions to determine the real estate market price closely to avoid tax losses. The Minister also requested the General Department of Taxation to continue to coordinate closely with notary organizations, relevant state agencies (land registration department, police, local authorities...) to effectively implement measures to prevent tax losses in real estate trading and transfer activities.
The General Department of Taxation shall strengthen inspection and strictly handle violations by civil servants; quarterly report on the results of the work to combat tax losses in business activities and real estate transfers; and the results of inspections of taxpayers' files that have made additional declarations but have not changed the transfer price.
According to the General Department of Taxation, along with the above solutions, the Tax sector will advise competent authorities to amend and supplement legal policies (such as adjusting the annual land price list) to perfect the legal basis and enhance management efficiency for real estate transfer activities.
