The announcement clearly stated that in recent times, the Party and State have always paid special attention to and directed the implementation of institutional building work, including the policy of continuing to innovate legal building thinking with an open, creative approach, boldly piloting new practical issues; ensuring the requirements of "Open Institutions - Smooth Infrastructure - Smart Governance"; promptly removing difficulties and obstacles, unleashing all potentials and resources to meet the development requirements of the country in the new era - the era of striving to develop richly, civilizedly and prosperously for the nation.
At the 9th Extraordinary Session, in order to institutionalize the policy of streamlining and streamlining the state apparatus and immediately remove bottlenecks and barriers in a number of legal regulations, piloting the application of a number of specific mechanisms and policies, the National Assembly passed 04 Laws amending and supplementing a number of articles of the Laws on the organization of the National Assembly, the Government, and local governments, promulgating legal documents and 08 Resolutions on piloting a number of specific mechanisms and policies to create breakthroughs in science and technology development, innovation and digital transformation; investing in the construction of nuclear power projects, developing urban railway networks. The promulgation of these laws and resolutions has promptly institutionalized the Party's resolutions and conclusions, in line with the practical situation and meeting the requirements of national development in the new situation; contributing to promoting decentralization, decentralization, reducing intermediaries, cutting and simplifying administrative procedures for people and businesses.
The implementation of laws and resolutions has had many positive changes. The Government and the Prime Minister have paid special attention to and closely directed ministries, branches and localities in implementation, prioritizing the allocation of resources and necessary conditions for the implementation of laws and resolutions; focusing on training and coaching; innovating the forms of dissemination and education of laws, and promoting policy communication. However, the work of building and organizing the implementation of laws still has some shortcomings and limitations such as: the situation of slow issuance of detailed regulations for implementation has not been completely resolved; the work of monitoring, inspecting, urging and evaluating the effectiveness of the organization of the implementation of legal documents is still formal; the work of communication, dissemination and education of laws has not had many breakthroughs; resources for the work of building and organizing the implementation of laws have not been allocated appropriately...
The assignment of tasks in the construction and organization of law enforcement must ensure 5 clear requirements.
In the coming time, in order to continue promoting the achieved results, overcome shortcomings and limitations, and further promote the role of institutional building and improvement for the country's development in the new development stage, the Government and the Prime Minister request that Ministers, Heads of ministerial-level agencies, Government agencies, and Chairmen of People's Committees of provinces and centrally run cities directly lead and direct the work of building and organizing law enforcement; promote the role and responsibility of the head with the spirit of "The Party leads, the Government is unified, the National Assembly supports, the People agree, the Fatherland expects, then only discuss and do, not discuss back"; the assignment of tasks in the work of building and organizing law enforcement must ensure the requirements of 5 clarity: "clear work, clear people, clear deadline, clear responsibility, clear results" and have mechanisms and policies for timely rewards and handling of violations; Focus on resolutely and effectively implementing the proposed tasks and solutions, paying attention to the following key contents:
Closely follow the Party's guidelines and policies, ensure the Party's comprehensive leadership in the work of building and organizing law enforcement; thoroughly grasp the Party's guidelines and policies, resolutions and conclusions of the Central Committee, the Politburo and the Secretariat on the work of building and organizing law enforcement; focus on building a culture of law compliance, integrity, and non-corruption, waste and negativity, first of all among cadres and Party members of agencies and organizations in the political system.
Closely follow the requirements, new contents, and focus of each law and resolution passed by the National Assembly at the 9th Extraordinary Session. The Ministries of Justice, Home Affairs, Science and Technology, Construction, and Industry and Trade shall take the lead in promptly, resolutely, and effectively implementing the laws and resolutions according to their assigned functions and tasks; submit to the Government for promulgation in March 2025 for 07 decrees detailing the implementation of the laws and resolutions passed by the National Assembly at the 9th Extraordinary Session.
Determined to completely resolve the situation of slow issuance of detailed regulations
The Government requests to concentrate resources, urgently develop, promulgate according to authority and submit to the Government and the Prime Minister for promulgation in March 2025, and no later than April 2025 for 45 documents detailing laws and resolutions that have come into effect, determined to completely resolve the situation of slow promulgation of detailed documents; speed up the development and promulgation of 108 documents detailing laws and resolutions that will come into effect from April 1, 2025 and in the coming time.
Continue to promote the spirit of close and effective coordination between the Government, the National Assembly, the National Assembly Standing Committee and relevant agencies in the work of building and organizing the implementation of laws. Tighten discipline, discipline, promote the responsibility of leaders and individual officials, civil servants, combined with strengthening supervision and inspection to promptly detect, prevent and resolutely handle acts of corruption and negativity in law enforcement; regularly evaluate the effectiveness of law enforcement. Strengthen the dissemination of laws and resolutions so that agencies, organizations and individuals understand the regulations correctly and fully. Focus on policy communication, dialogue, and listening to the opinions of people and businesses in the process of building and implementing laws.
Urgently review and propose amendments and supplements to a number of articles of the Constitution, including issues related to organizational structure; study and propose amendments to legal documents under the authority of the National Assembly and the National Assembly Standing Committee related to the implementation of Conclusion No. 127-KL/TW dated February 28, 2025 of the Politburo and the Secretariat; continue to review and propose solutions to difficulties and inadequacies, especially issues related to decentralization, delegation of power, and simplification of administrative procedures.
People's Committees of provinces and centrally run cities shall organize the dissemination and promulgation of plans for the implementation of laws and resolutions in their localities; prepare necessary conditions to organize the implementation of assigned tasks and powers; promptly report to competent authorities on issues arising beyond their authority.
Improve the effectiveness of coordination in law enforcement organizations
In order to improve the effectiveness of coordination in law enforcement, the Government proposes that the Nationalities Council and the National Assembly Committees continue to closely coordinate with the Government right from the initial stages of law-making, exchange and discuss issues with different opinions on draft laws, ordinances and resolutions; strengthen supervision activities in law-making and law enforcement, promptly detect illegal contents and violations to propose appropriate handling measures.
The Central Committee of the Vietnam Fatherland Front participates in the development and contribution of opinions to the development and promulgation of legal documents; proactively participates in the dissemination and education of law; strengthens social supervision and criticism activities, ensuring the legitimate and legal rights and interests of the People.
