Clarifying the relationship between urban and rural planning

Delegate Hoang Van Cuong (National Assembly Delegation of Hanoi) emphasized that urban planning and rural planning are two different categories but are intertwined. Therefore, the development of the Law on Urban Planning and Rural Planning is extremely necessary to have a synchronous planning system, ensuring integration, comprehensiveness, avoiding overlapping plans, and harmoniously combining urban development with rural construction.

Delegates said that although urban and rural planning has been screened, there are still overlaps within the planning system adjusted in this Draft Law as well as the planning adjusted in the Law on Planning.

Delegate Hoang Van Cuong cited that according to this Draft Law, in the province, there will be a general planning for provincial cities, a general planning for towns, and a general planning for districts with the same coverage ratio for the entire space of a province, but then there will be a general planning for functional areas.

Or there is an urban zoning plan but there is a town plan with the same scale; the district's general plan and the commune's general plan are also at the same scale. How will the district's general plan and the district's regional plan be separated to avoid overlap?

Currently, there are cases where the general planning often repeats the provincial planning. Therefore, the delegate suggested that the Draft Law should review and clarify this issue.

Delegate Nguyen Hai Nam (National Assembly Delegation of Thua Thien Hue Province) said that there are some overlapping points in the regulations related to the two types of planning, so the drafting committee needs to pay attention to absorb and amend them. Besides, if these two types of planning are integrated, there will also be issues that are difficult to implement, so it is necessary to establish a general urban plan and in some places, a general plan for a centrally-run city.

Delegate Mai Van Hai (National Assembly Delegation of Thanh Hoa Province) basically agreed with Clause 1, Article 3 regulating types of urban and rural planning. However, the delegate suggested that it should be further reviewed to comply with the provisions of the 2017 Planning Law.

At point a, clause 1, the delegate suggested that it should not be re-regulated because the 2017 Planning Law has already regulated it. At point b, point c, clause 1, delegate Mai Van Hai suggested clarifying the relationship between urban planning and rural planning which are national sectoral planning and urban planning and rural planning which are part of the national planning system.

To avoid overlap between plans, delegates also suggested considering the relationship in establishing urban and rural plans, especially rural plans for districts and communes, and urban plans for towns, townships, and new urban areas.

Supplementing regulations on consulting people on planning

Participating in the discussion, delegate Nguyen Thi Ngoc Xuan (National Assembly Delegation of Binh Duong province) commented on Article 15 on the procedures for establishing, appraising and approving urban and rural planning, including the recommendation to add the content of collecting public opinions on planning to comply with current laws.

Delegate Tran Van Tien (National Assembly Delegation of Vinh Phuc Province) proposed to add a provision stating that the State shall ensure funding for urban and rural planning activities. Regarding the procedure for adjusting urban and rural planning, the delegate suggested that when adjusting a local plan without changing the planning objectives, the authority should be delegated to a lower level to organize the implementation, in order to reduce administrative procedures and reduce the time for local planning adjustments. At the same time, it is necessary to clearly stipulate the time for making, appraising and approving the overall adjustment and local adjustment of urban and rural planning.

Delegate Duong Khac Mai (National Assembly Delegation of Dak Nong Province) emphasized that in the trend of opening up, receiving and absorbing influences from many cultures, urban planning and rural planning are facing great challenges, most noticeable in terms of architecture. Globalization, modernization and urbanization have given rise to a number of negative impacts on traditional architectural values. Rural landscapes are also gradually losing cultural symbols such as banyan trees, communal houses, houses with traditional architecture, etc.

Therefore, to ensure sustainable development planning, in Article 7 on principles of urban and rural planning activities, it is necessary to study and supplement the principles on protecting, inheriting, promoting traditional values, national cultural identity, and respecting regional cultural space. Similarly, it is recommended to review Clause 6, Article 2 on the interpretation of terms to supplement cultural factors associated with socio-economic factors.

Should the planning agency and the planning appraisal agency be independent?

Delegate Nguyen Truc Anh (National Assembly Delegation of Hanoi) expressed his opinion that Clause 6 and Clause 9, Article 16 of the Draft Law stipulate that the planning organization and the appraisal agency must be independent, however, in reality, this is very difficult to implement. Therefore, the delegate recommended that due to the specific nature of architectural planning, it is not necessary to stipulate that the appraisal agency and the planning organization must be independent.

At the same time, regarding Article 18 of this Draft Law on the form and selection of planning consultants, it is necessary to have the form of assignment and ordering, the form of bidding and competition is heavily influenced by the form of public investment projects, delegate Nguyen Truc Anh also recommended that each province and city from type 2 urban areas and above should regularly implement architectural management work in the area, for type 1 urban areas and above, there must be a Department of Planning and Architecture to carry out State management in the field of architectural planning.

Commenting on Clause 1, Article 18 of the Draft Law on the selection of consulting units according to the provisions of law on bidding or selection in the form of a competition for planning ideas, delegate Nguyen Phi Thuong (National Assembly Delegation of Hanoi) proposed to increase the limit of designated bidding for consulting packages related to planning preparation and adjustment to no more than 1 billion VND to speed up planning preparation. Particularly for consulting packages using non-refundable funding from domestic and foreign enterprises and organizations, the designation of consulting units is carried out regardless of the limit.

 

Regarding the role and necessity of establishing a master plan for a centrally-run city, in his explanatory speech, Minister of Construction Nguyen Thanh Nghi said that the content of the planning for a centrally-run city is stipulated in the Law on Planning. Accordingly, the content of the planning for a centrally-run city only stipulates the plan for developing the urban system in the city and does not stipulate the proposal of a model for urban development structure, orienting the development of the overall space and each area to organize architectural landscape space, orienting the development of functional areas of the city's technical infrastructure system and social infrastructure with controls on technical indicators according to relevant planning standards and regulations.
